AN ORDINANCE AMENDING ORDINANCE NO. 1+77-A OF THE CITY OF
GILROY PROVIDING FOR THE EXTENSION OF THE SEWER SYSTEM
AND WATER SYSTEM OF ~E CITY OF GILROY, AT THE EXPENSE OF
THE APPLICANTS THEREFOR, PROVIDING THE CONDITIONS UNDER
WHICH EXTENSIONS MAY BE MADE AND TijE DETFBMINATION OF THE
COSTS BY THE PROPERTY OWNERS., BY AnDING SUBDIVISIONld
TO SECTION ONE OF SAID ORDINANCE PERMITTING THE CITY at
GILROY TO INITIALLY DEFRAY A PART OF THE EXPENSE.
THE COMMON COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION 1. That Section One ot Ord1n~nce No. 1+77.A ot the City ot

Gilroy is hereby amended by adding thereto a new subdivision to pe known
as Subdivision ~d) to read as tollows:
(d) Where the applications tor an extension of the sever system
ot the City of Gilroy under the provisions ot this ordinance~'rtr1ate to a

particular area or section of the City so that the same may b~.t~4 a
District, the work of constructing the extension of the sewer andiwater
system into the area pursuant to the applications may be undertaken by the
City even though some property owners may not have signed a)~lications or
paid or agreed to pay their share ot the cost thereof. In cases, where the
non-Signing owners are 'few in number compared with the total number of
applicants, the City of Gilroy may initially pay the cost of the sewer
extension wh~ch such property owners would have paid had they executed an
application pursuant to this ordinance, if, in the judgment of ,the Common
Council, theCj;ty can afford to defray the expense , and the amount thus ex-
pended may, in its judgment, be recoverable under other provisions of this
ordinance.
SECTION 2. This ordinance shall take effect and be in full force
from and after its passage and approval.
