Q R ~I_N_A_N_C_E 1f Q ..:. 501 AN ORDINANCE OF THE CITY OF GILROY REGULATING THE HEIGHT OF FENCES IN THE CITY OF GILROY. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . THE CO:tJ1MON COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: ,.., SECTION I: No fence shall hereafter be constructed, erected, or placed upon any property in a residential district in the City of Gilroy, that is upon property in an "All or "Ell district as the same are defined in Zoning Ordinance No. 422 of the City of Gilroy, except as follows: (a) Along any alley, the height of a fence shall not exceed seven (7) feet from the ground. (b) From the nearest alley line or rear property line to the front line of the main wall of the dwelling, the height of the fence shall not exceed six (6) feet, and if no dwelling is on the property on which the fence is to be erected or placed or constructed, then such fence shall be of such height not exceeding six (6) feet as may be permitted by the Building Inspector of the City of Gilroy, the decision of the Building Inspector to be subject to the right of the applicant for a permit to appeal to the Common Council. (c) In all other cases, a fence shall not exceed three (3) feet in height. SECTION II: No fence shall be hereafter erected in the City of Gilroy without a permit being first obtained from the Building Inspector of the City of Gilroy, and the application for the permit shall show the location of the fence on a sketch, diagram, or platt of the property on which it is to be erected or placed, and the location and designation of the buildings thereon. Any person violating this ordinance or any part thereof shall be deemed guilty of a misdemeanor and upon conviction shall pay a fine of not in excess ot $100.00 or be imprisoned in the city jail tor a period of not more than thirty (30) days, or both such fine and imprisonment. SECTION IV. Any fence erected contrary to the provisions of this ordinance shall be removed upon the order of the Common Council. SECTION V. This ordinance shall be in full force and effect trom and after its passage and approval. SECTIOI:VI. All ordinances and parts of ordinances in conflict , herew~hare hereby repealed.
