N Q. 510 n AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING NAPLE STREET BETWEEN 7TH STREET AND OLD GILROY STREET IN THE CITY OF GILROY WHEREAS the COtiIDlOn Council of the City of Gilroy did on the 19th day of August, 1953 duly pass and adopt Ordinance Noo 509 whereby it declared its intention to proceed under the Street Vacation Act of 1941 and vacate that portion of Maple Street in the City of Gilroy, lying between 7th Street and Old Gilroy Street, reserving and excepting easements and rights as her.einafter set forth and the said Council having in mid ordinance fixed Tuesday, the 8th day of September, 1953 at the hour of 8:00 P.Mo in the Common Council Chambers in the City Hall as the hour and place for hearing objections to the said proposed vacation; and WHEREAS the City Clerk of the City of Gilroy did cause notice of the time and place of the s aid hearing to be published and posted in accordance with the order of the Common Council and in accordance with law ~nd said hearing having been held at the time and place specified and no one appe~ring to object to said street vacation; THE :HAYOR AND CONMON COUNCIL OF THE CITY OF GILROY DO ORDAIN AS FOLLOWS: Section 1: Maple Street in the said City of Gilroy between 7th Street and Old Gilroy Street is hereby abandoned and vacated; provided, however, that in the vacation of said street the City of Gilroy does hereby reserve and except the permanent easement and right at any time or from time to time to construct, maintain, operate, replace, remove and renew sanitary and other sewers and drain and w~ter pipe lines and storm drains in, upon, over and across the part of said Street so vacated, and pursuant to any franchise thereof or renewals thereof, or otherwise, to construct, operate, maintain, replace, remove, renew, and enlarge lines of pipes, conduits, cables, wires, poles and other convenient structures, equipment, and fixtures for the operation of gas pipe lines, telegraphic and telephone ~fO #'~. ... b lines, and for the transportation or distribution of electrical energy and water.
