ORDINANCE AHENDING ORDINANCE NO. 422, CON.~10~TLY KNOWN AS THE
ZONING ORDINA:OCE OF THE CITY OF GILROY, BY HE-ZONING CERTAIN
PROPERTY N0\1 IN uB" ,IICII, AND uEtt ZONFS AND PLACING SAME IN
"D" ZONE.
WEEREAS, the City Planning Cormnission of the City of
Gilroy has heretofore proposed that Ordinance No. 422 of the
City of Gilroy, known as the "zoning ordinance" be amended
by taking from Zones ttBtt, "C.., '-l.nd "Ett as the same are defined
in sa.id Ordinance, and placing the same in "Du zone, the follow-
ing 0escribed property located in the City of Gilroy, County
of Santa ~lara, state of California, to-wit:
Beginning at a point in the northerly
cit,T limits of the City of Gilroy,
distant thereon 300.00 feet westerly from
the westerly line of Monterey street or
Highway, and running thence in a southerly
direction at a uniform distance of 300.00
feet from the said westerly line of Monterey
Street to the southerly line of Miller Slough,
the same being the northerly boundary line
of the King's Rest Motel property, and
running thence in a westerly direction along
the westerly line of Miller Slough to the
~oint where sqid slough turns North and
following the South and West line of the
slough through the curve to the North, and
the11. following the 1/1esterl'T boundary line
of the slough ~orth to its intersection with
the southerly line of vlelburn Avenue, and
thence running at a uniform castance from
~onterey Street to the northerly city limits
of the City of Gilrov, and thence in an
easterly direction along the northerly city
limits to the ~oint of begi~ing, the South
and T!.Jest boundary lines of sai.d premises '-1eing
the South and ,rest lines of the said Miller
Slough.

\~HEREAS, a hearing has been had before the

Planning Commission of the City of Gilroy on the said proposal
and notice thereof has neen given in accordance with law and
the ordinances of the City of Gilrov; and,

City Planning Commission having duly made its report~findings
and making its recom~ennation to the CO'ffion Council, in which

report it recommends that said ordinance No. 422 be amended in
accordance with said proposal; and,
WHERFAS, the Common Council of the City of Gilroy has
heretofore by resolution fixed Monday, the 17th Gav of January,
1955, at the hour of 8:00 o'clock p.m. in the Common Council
room in the City Hall, Gilroy, California, as the time and place
for hearing objections to the proposed amendment, and notice of
the said hearing has been given as required by law and the
ordinances of the City of Gilroy; and,
W dEREA.S, the said Common Council of the City of Gilroy
did on this 17th day of January, 1955, at the hour and place
of the said hearing and in the said notice thereof, proceed to
hold the sai~ hearing, and 1)0 objections having been made to
the said proposed amendment, and the Co~non Council of the City
of Gilroy having duly considered the matter and having determined
that the said amendment to said Ordinance No. 422 should be
adopted in accoraance with said proposal.
N01IJ, THEREFORE, THE VJAYOR AND C0Jv1!10N COUNCIL OF THE CITY
Oli' GIlROY DO ORDAIN AS FOLLOWS:
Sectio:q ~ That Ordinance No. );..22 of the City of Gilroy,
commonly known and designated as the "Zoning Ordinance" of said
city be, and the same is amended as follows:
That there be, and there is hereby, taken from Zones
tlB" ,tlCtl, and "'E" as the same are nefined in the said ordinance,
the premises hereinbefore described, located in the City of Gilroy,
County of Santa Clara, P1tate of California, and the same shall
be and are hereby nlaced in and become a part of "D" Zone as the
same is defined in the said ordinance.
Section Two: This ordihance shall be in full force and
effect from and after its passage and adoptiOR.
