ORDINANCE NO. 530 AN ORDINANCE AMENDING ORDINANCE NO. 422, COMMONLY DESIGNATED AS THE ZONING ORDINANCE OF THE CITY OF GILROY, BY REZONING CERTAIN PROPERTY NOW IN ZONE ttEtt TO ZONE ttDtt, AND CHANGING THE BOUNDARY LINES OF SAID ZONES. WHEREAS, Be Ge r~nufacturing Company, a corporation, has heretofore filed a petition with the City Clerk of the City of Gilroy, asking that certain premises therein described be re- zoned from Zone nEtt to Znne ttDn, as said zones are designated and described in Ordinance No. 422 of the City of Gilroy, generally known as the zoning ordinance of said City, and WHEREAS, the Common .Council of the City of Gilroy has heretofore referred the said petition to the City Planning Commission of the City of Gilroy for investigation and report, the said City Planning Commissi0n of the City of Gilroy has held hearings and given notice thereof in accordance with law, and after having heard objections to the said rezoning, has adopted and filed with the City Clerk of the City of Uilroy, its findings and recommendations in the matter of said rezoning, and WHEREAS, upon the filing of said recommendation and report, the Common Council of the City of Gilroy fixed the 27th day of June, 1955, at the hour of 8 o'clock p.m. of said day, in the Council Chambers in the City Hall, in the City of Gilroy, California, as the time and place for the hearing of said petition, and any objections thereto that might be made, and due notice having been given of the said hearing in accordance with law, and the matter having been regularly heard by the Council at the said time amd place appointed therefor, and objections having been made to the said zoning Change, and having been considered by the said Common Council of the City of Gilroy, ,530 '" as well as the entire matter of said rezoning, and having determined that the best interests of the City of Gilroy re- quires that the said petition be granted as to the portion of the property therein described that is hereinafter set forth, and denied as to the remaining portion, and WHEREAS, the said rezoning can only be accomplished by the adoption of an amendment to the said Ordinance No. 422, NUW, THEREFORE, BE IT RESOLVED that the said petition of said Be Ge Manufacturing Company be granted as to all the property hereinafter described and denied as to the remaining portion of said property, and BE IT FURTEER RESOLVED and the Mayor and the Common Council of the City of Gilroy do hereby ordain as follows: SECTION I: That the Ordinance No. 422, of the City of Gilroy, commonly known as the general zoning ordinance of the City of Gilroy, be and it is hereby amended as follows: (a) That there be, and there is hereby taken from Zone "Ell and placed in Zone "D", as said zones are defined in the said zoning ordinance of the City of Gilroy, the fOllowing described premises heretofore in Zone liE", to-wit: BEGINNING at the point of intersection of the northerly line of Leavesley Road, with the westerly line of Murray Avenue, and running thence in a north- westerly direction along the said westerly line of Murray Avenue to the point of intersection of said line of Murray Avenue with the northerly corporate limits of the City of Gilroy, as they now exist, same being the common corner of Lots 7 and 8, as shown upon Henry Miller's Subdivision of the southerly portion of Las Animas Ranch Lot 34 and Sublot 2, accord- ing to the map thereof recorded in Book "M", page 79, of the Records of Santa Clara County' thence westerly along the line common to Lots 7 and 8 755.49 feet; thence north 22020' West 264.28 feet to the line common to Lots 6 and 7, as shown on said map; thence along said line . south 67040' west 40 feet to the westerly common corner of Lots 6 and 7; thence along tl1e southwesterly line of Lot 6 north 220 20' west 264.28 feet to the most westerly corner of Lot 6; thence south 670 37' west 826.57 feet to the easterly line of the Southern Pacific Railroad right of way at the most westerly corner of that certain 20 acre tract of land described in Deed recorded in Book 439, on page 45, Official Records of Santa Clara County, thence along the 2 .... ~ ... .. .... .... lit ~.~ . easterly line of the Southern Pacific Railroad right-of-way South 220 201 Sast 863.15 feet to the intersection thereof with the original northerly corporate limits of the City of Gilroy; thence northeasterly along the said original northerly corporate limits of the City of Gilroy to the point of intersection thereof with the westerly line of Swanston Lane, projected north- westerly ; thence in a southeasterly direction along the said westerly line of the said Swanston Lane, as projected, to the northerly line of the Leavesley Road; thence in a northeasterly direction along the northerly line of the L~avesley Road to its intersection with the Westerly line of Murray Avenue. EXCLUDING and EXCEPTING from the said premises as above described, the following described portion thereof: BEGINNING at a point on the Westerly line of Murray Avenue, distant thereon 117 feet northerly from the point of intersection of said line of Murray Avenue with the northerly line of Leavesley Road, running thence in a southwesterly direction and parallel with the northerly line of Leavesley Road 128.11 feet; thence in a northwesterly direction and parallel with the westerly line of Murray Avenue 464.83 feet to the line dividing Lots 8 and 9, as shown on the aforesaid map; thence along the said lin! dividing said Lots 8 and 9 in a southwesterly direction 17.18 feet, and thence North 220 2Qr West parallel with the westerly line of Murray Avenue l8&20ft; thence south 670 40' West 22.89 feet; thence northwesterly parallel with the westerly line of Murray Avenue 78.08 feet to the present northerly City Limits of the City of Gilroy, same being on the line dividing said Lots 7 and 8, as shown 0n th~ aforesaid map; thence along said line and said northerly limits of the City of Gilroy in a northeasterly direction to the ~esterly line of Murray Aven~e; thence in a southeasterly direction along th~l~ine of Murray Avenue to the point of beginning. 1 SECTION II: All ordinances and parts Of ordinances in conflict herewith are hereby repealed. SECTION III: This 0rdinance shall take effect and be in full force from and after its adoption and approval.
