Ordinance 547 ORD INANCE NO. 54? AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAI N UNINHABITED TERRITORY, TO BE KNOWN AS ttTHlD WESTERN ADDITION TO THE CITY OF GIIROY", AND FOR THE INCORPORATION OF SUCH ANNEXED TERRITORY IN AND AS A PART OF SUCH MUNICIPAL ITY FCR THE GOVERNMENT AND MUNICIPAL CONTROL OF SUCH ANNEXED TERRIT ORY . WHEREAS, a written petition has heretofore been filed in the office of the City Clerk of the City of Gilroy under the provisions of the UAnnexation of Uninhabited Territory Act of 1939", as set forth within sections 35300 to 35325 inclusive of the Government Code, asking that there be anr:exed to the City of Gilroy, as uninhabited territory, certainproperty located in the County of Santa Clara, therein and hereinafter more particularly described; and, WHEREAS, it appears that the said petition has been signed by the owners of all of the land in the territory sought to be annexed by area, and that the said tract of land is contiguous to the present city limits of the City of Gilroy; and, WHEREAS, the proposal to annex the said territory to the City of Gilroy has heretofore been submitted to the Boundary Commission of the County of Santa Clara, and the said Boundary Commission has reported ap~oving the definiteness and certainty of the boundaries of the said territory; and, WHEREAS, the proponents of said annexation have heretofore submitted to the City Planning Commission of the City of Gilroy the proposal for the annexation of the said territory to the said City of Gilroy, and the said City Planning Commission has reported to t he Common Council of the City of Gilroy approving and recommending the annexation of the said tract; and, WHEREAS, the said Common Council of the City of Gilroy did heretofore and on the 20th day of August, 1955, adopt Resolution No. 391 finding the foregoing as facts, and fixing Monday, the 15th day of October, 1956, at the hour of 8:00 o'clock p.mo of said day in the Common Council Chambers, in the City Hall, Gilroy, California, as the time and place for the hearing of said petition and proposal to annex said territory, which Resolution complied with the provisions of sections 35305 and 35306 of the Government Code; and, WHEREAS, notice of the said hearing has been given as required by Sections 35307 and 35311 of the said Government Code by pub" lication of a copy of said Resolution, in the Gilroy Evening Dispatch, a newspaper published in the said City of Gilroy, and also a like copy by publication in the Morgan Hill Times, a newspaper published in the said County of Santa ClaraJ but outside the boundaries of the said City of Gilroy, as required by law and the previous order of the Common Council, and also by the giving of a notice of the time and place of the hearing by the City Clerk of the City of Gilroy to each person to whom land lying within the District proposed to be annexed is assessed in the last equalized County assessment roll at the address shown or as known to the said City Clerk; and, WHEREAS, the said Common Council of the City of Gilroy has now held the said hearing and no objections or protests to said proposed annexation having been filed on or before the time of ~il the said hearing as fixed in the aforesaid Resolution; and notice, and the said Common Council, having duly considered the matter of said annexation and deeming it desirable and for the best interests of the said City of Gilroy that the said territory be annexed to the said City of Gilroy: THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO HEREBY OHDA IN AS FOLLOWS: SECTION I: Under the autho~1ty of the said "Uninhabited Territory Act of 1939", as set forth in Sections 35300 to 35326 of the Government Code of the State of California, the same being Chapter 297, statutes of 1939 and amendments thereto, there is hereby annexed to the said City of Gilroy as uninhabited territory, the property and premises herein~ before mentioned which are more particularly described as follows: Being a portion of Las Animas Ranchlots 16 and 20 as shown on Map No. 7 acco mpanying the report of the Referees in the Las Animas Rancho Partition SUit, Action No. 5536 had in the SUperior Court of the State of California, in and for the County of Santa Clara, and being more particularly described as follows: Beginning at the intersection of the southerly line of "Castlewood Park Unit No. I" as shown on the Map thereof recorJed in Book IS of Maps at page 40, with the westerly line of Miller Avenue, and running thence along the westerly line of Miller Avenue S .0046tt'w. to the intersection thereof with the southeasterly line of Sixth street; thence along the southeasterly line of Sixth street N.69059'E. to the intersection thereof with the southwesterly line of Princevallestreet and the present Corporate Limits of the City of Gilroy; thence along said line N .20 oW. to the intersection thereof with the southeasterly line of Fifth Street; thence along the S) utheasterly line of Fifth street s.69 o59'W 0 to the intersection thereof with the easterly line of Miller Avenue; thence along the easterly line of Miller Avenue N.0~6t'E. to the intersection thereof with the projected southerly line of said IlCastlewood Park, Unit No. 1"; thence along said southerly line N.890l0f30'W. 80.00 feet to the point of beginning, and CONTAINING THEREIN 20.7 acres of land, more or Ie s s .
