Ordinance 570 II< ""~ '.. o R DIN A N C E NO. 570 AN ORDINANCE AMENDING SUBDIVISION NO. 5 OF SECTION NO. 240 OF THE MUNICIPAL CODE OF THE CITY OF GILROY, RELATIVE TO THE FIRE LIMITS, AND ESTABLISHING THREE FIRE ZONES. THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN AS FOLLOWS: SECTION I. That Subdivision 5 of Section 240 of the Municipal Code of the City of Gilroy be and is hereby amended to read as follows: Subdivision 5. The City of Gilroy shall be and is hereby divided into three (3) fire zones hereby designated as the first fire zone, second fire zone and third fire zone. The boundaries and description of said fire zones are as follows: A. The First Fire Zone shall comprise all the territory in the City of Gilroy described as follows: Commencing at the point of intersection of the center line of Third Street with the Northerly prolonga- tion of the center line of the alley extending in a ' general northwesterly and southeasterly direction through Block 3 North of Range 1 West of the City of Gilroy and running thence along the said center line of said Third Street in a northeasterly direction to the center line of Monterey Street; thence in a northwesterly direction along the said center line of said Monterey Street to its inter- section with the southwesterly prolongation of the southerly line of I.O.O.F. Avenue; thence northeasterly along the said prolongation and said southerly line of said Avenue to its intersection with the westerly line of the right of way of the Southern Pacific Railroad Company; thence in a south- easterly direction along the said westerly line of said right of way and its southeasterly prolongation to the point of intersection therewith of the northeasterly pro- longation of the center line of that part of Eighth Street lying west of Monterey Street, thence in a Southwesterly direction along said prolongation and said center line of Eighth Street to its intersection with the center line of the Southeasterly prolongation of the alley extending through Block 2 South of Range 1 West of the City of Gilroy; said point of intersection being 150 feet westerly of the westerly line of Monterey Street; thence in a northerly direction and parallel with the westerly line of Monterey Street to the center line of the Alley in the 6/0 northerly line of Seventh Street extending through Block One South of Range 1 West of the City of Gilroy; thence along the Center line of said alley in a northerly direction to the Southerly line of Sixth Street; thence in a northwest- erly line across Sixth Street to the point of intersection of the Northerly line of Sixth Street with the center line of the alley extending through Block One North of Range 1 West of the City of Gilroy; thence in a straight line along the center line of alleys in the intervening blocks to the point of beginning. B. The Second Fire Zone shall comprise the following described territory in the City of Gilroy: Commencing at the point of intersection of the westerly line of the right of way of the Southern Pacific Railroad Company with the easterly extension of the center line of that part of Eighth Street lying west of Monterey Street, said point of beginning being also the Nonthwesterly ~rner of Fire Zone Number One; running thence in a southerly direction along said westerly line of said right of way to the southerly Corporate Limits of the City of Gilroy; thence in a westerly direction along said southerly Corporate Limits to a point thereon distant 150 feet westerly from the westerly line of Monterey Street; thence in a northerly direction at a uniform distance of 150 feet westerly of the west line of Monterey Street to the center line of Eighth Street; thence along the center line of Eighth Street and its easterly extension to the point of beginning. ALSO, Commencing at a point in the center line of Seventh Street distant thereon 150 feet westerly of the Westerly line of Monterey Street, said point being in the westerly line of the First Fire Zone and running thence in a westerly direction along said center line of Seventh Street to the point of intersection of said center line with the southerly prolongation of the center line of the alley extending through Block 1 South of Range 2 West of the City of Gilroy; thence in a northerly direction in a straight line through the center of the intervening blocks to the Northerly line of First Street; thence in an easterly direction along the northerly line of First Street to its intersection with the southerly pn1ongation of the Easterly line of the alley forming the easterly boundary of Lot 1 of the Gurries Addition to the City of Gilroy; thence along said easterly line of said alley in a northerly direction to the most northerly corner of Lot 2 of said sub- division; running thence in a westerly direction along the northwesterly line of Lots 2, 3, 4 and 5 of said Gurries Addition to the most easterly corner of Lot 8 of said subdivision; thence in a northerly direction along the easterly line of Lots 8, 9, 10, 11 and 12 of said sub- division to the most northerly corner of said Lot 12 and thence along the northwesterly continuation of said line 328.67 feet to the northerly boundary line of said Gurries Addition to the City of Gilroy; thence north 87050'E. 45 feet; thence in a northwesterly direction parallel with the westerly line of Monterey Street to the Northerly City limits of the City of Gilroy; thence in an easterly direction along said northern City limits to the westerly line of the Southern Pacific Railroad Co. right of way; thence along said line -2- I' of said right of way to the Southerly line of I.O.O.F. Avenue, said point being the most northerly point of Number One Fire Zone; thence along the northerly and westerly lines of said Number One Fire Zone to the center line of Seventh Street to the point of beginning. ALSO, commencing at the point of intersection of the easterly city limits of the City of Gilroy with the northerly line of Old Gilroy Street, and running thence in a north- westerly direction along the said easterly city limits to a point that is 150.00 feet measured by the shortest distance from the1northerly line of Old Gilroy Street; thence running in a westerly direction at a uniform distance of 150.00 feet from the northerly line of Old Gilroy Street to the northeasterly line of Lot 4 in Block 2 South of Range 7 East of the City of Gilroy; thence in a southwesterly direction parallel with the southerly line of Eighth Street to the southwesterly line of East Street; thence in a northwesterly direction along the southwesterly line of East Street to the line dividing Lots 1 and 2 in Block 2 South of Range 6 East of the City of Gilroy, and thence in a southwesterly direction along the said dividing line to the center line of the alley running through said block; thence in a northerly direction along the center line of said alley and its northwesterly extension to the centerline of Seventh Street; thence in a westerly direction along the center line of Seventh Street to its intersection with the center line of Forest Street; thence in a northerly direction along the center line of Forest Street to its intersection with the northeasterly prolongation of the line dividing Lots 4 and 2 of Block 1 South of Range 3 East of the City of Gilroy; thence in a southwesterly direction along the said line dividing said Lots and its prolongation to the easterly line of Lot 5 in said Block; thence along the easterly line of said Lot 5 to the most northerly corner thereof; thence in a westerly direction along the northerly line of said Lot 5 and parallel with the southerly line of Sixth Street to the westerly line of Alexander Stre~ thence in a northwesterly direction along the westerly line of Alexander Street to a point thereon 149.50 feet northwest of the northerly line of Old Gilroy Street; thence at right angles in a southwesterly direction to the center line of the alley extending through Block 1 South of Range 2 East of the City of Gilroy; thence in a northwesterly direction and parallel with the easterly line of Railroad Street to the center line of Lewis Street; thence in a southwesterly direction along the center line of Lewis Street to its intersection with the center line of Railroad Street; thence in a southeasterly direction along the center line of Railroad ~treet to the center line of Old Gilroy Street; thence in an easterly direction along the center line of Old Gilroy Street to its intersection with the center line of Alexander Street; thence in a south- easterly direction along the center line of Alexander Street to its intersection with the westerly prolongation of the line dividing Lots 10 and 11 of Grant's Block; thence in an easterly direction along the said line and its said prolonga- tion to the westerly line of the alley running through said Grant's Block; thence in an easterly direction to the westerly common corner of Lots 1 and 2 of said Grant's Block; thence in an easterly direction along said line dividing said Lots 1 and 2 and the easterly prolongation thereof to the -3- ~ center line of Forest Street; thence in an easterly direction to a point on the easterly line of Forest street distant thereon 195.51 feet southeasterly from the point of intersection of the said line of Forest Street with the southerly line of Old Gilroy Street; thence in a northeasterly direction parallel with the northerly line of Eighth Street 150.00 feet; thence at right angles in a southeasterly direction 45 feet; thence at right angles in a northeasterly direction to the westerly line of Chestnut Street; thence in an easterly direction across Chestnut Street to a point thereon 150.00 feet measured by the nearest distance from the southerly line of Old Gilroy Street; thence in an easterly direction parallel with the southerly line of Old Gilroy Street to the center of Maple Street; thence in a southeasterly directionaong the center line of Maple Street to its intersection with the center line of Eighth Street and thence in a northeasterly direction along the center line of Eighth Street to the easterly city limits of the City of Gilroy and thence in a northwesterly direction along said city limits to the point of beginning. ~. ALSO commencing at the point of intersection of the southerly line of Hecker Pass Highway with the easterly line of Miller Avenue and running thence southerly along the easterly line of Miller Avenue 190 feet; thence in a northeasterly direction to a point on the southwesterly line of Princevalle Street 150.00 feet southeast on said line from the southerly line of Hecker Pass Highway; thence in a northeasterlymrection across Princevalle Street to the point thereon common to Lots 10 and 11 in Block 5 North of Range 7 West of the City of Gilroy; thence in a northeasterly direction along the line dividing said Lots 10 and 11 the easterly line of the alley extending through said Block; thence in a southeasterly direction along the said line of said alley to the most southerly corner of Lot 1 in said Block; thence in a northeasterly direction along the south- easterly line of said Lot 1 and its northeasterly prolonga- tion to the center line of Carmel Street; thence in a southeasterly direction along the center line of Carmel Street to a point thereon that is 140 feet south measured by the nearest distance to the southerly line of Hecker Pass Highway; thence in an easterly direction and parallel with the southerly line of Hecker Pass Highway to the westerly line of Hanna Street; thence in a northeasterly direction across Hanna Street to the point on the easterly line of Hanna Street common to Lots 6 and 7 in Block 5 North of Range 4 West of the City of Gilroy; thence in a northeasterly direction along the southeasterly boundary line of Lots 5 and 6 in said Block to the most easterly corner of Lot 5 and thence in a northwesterly direction along the northeasterly line of said Lot 5 and its most westerly prolongation to the center line of First Street; thence in a northeasterly direction along the center line of First Street to an intersection therewith of the westerly line of Church Street; thence along the westerly line of Church Street to the center line of the alley in the Gurries Addition and extending in a northeasterly and southwesterly direction between Gurries -4- .. Drive and First street; thence in a southwesterly direction along the center line of said alley and its southwesterly extension to the westerly line of Hanna street; thence in a northwesterly direction along the westerly line of Hanna street to the line dividing Lots 8 and 9 in Block 6 North of Range 5 West, Loupes Northern Addition to the City of Gilroy; thence in a southwesterly direction along the line dividing said Lots 8 and 9 of said subdivision to the most westerly corner of Lot 9; thence in a southeasterly direction along the southwesterly line of Lots 9, 10 and 11 to the northeasterly line of Lot 21; thence along the northeasterly line of Lots 21, 22, 23, 24, 25, 26, 27, 28, and 29 to the easterly line of Sargent Street; thence in a westerly direction and parallel with the northerly line of Hecker Pass Highway to the easterly line of Sublot 41 of the Las Animas Partition; thence in a northerly direction along the easterly line of said Sublot 41 to the northeasterly corner thereof; thence in a westerly direction along the northerly line of said Sublot 41 to the northwesterly corner thereof; thence in a southerly direction along the westerly line of said Sublot 41, 45.00 feet; thence in a westerly direction parallel with the northerly line of Hecker Pass Highway to the center line of wayland Lane; thence in a south- easterly direction along the center line of Wayland Lane to its intersection with the northerly prolongation of the easterly line of Miller Avenue and thence in a southerly direction to the point of beginning. C. The third fire zoneaomprises all that part of the City of Gilroy not included in the first or second fire zones. SECTION 2. All of the building restrictions and conditions set forth in Ordinance 569 of the City of Gilroy shall apply to structures, buildings and works within the fire zones as established i 1 Section 1 of this Ordinance, except in the following particulars (1) Any residence in existence and used as such at the time of adoption of this ordinance, located within the boundaries of that portion of the fire district included within the limits of a C-l district, as described and classified in Ordinance No. ko8, amending Ordinance No. 422 of the City of Gilroy, may be remodeled or rebuilt in the event that the same is damaged or destroyed by fire, to be used only as a dwelling. This Ordinance shall take effect and be in full force from and after its passage and approval. SECTION 4. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed.
