Ordinance 572 .' ORDINANCE NO. 572 AN ORDINANCE OF THE CITY OF GILROY REGULATING THE HEIGHT AND LOCATION OF FEPCES IN THE CITY OF GILROY AND REPEALING ORDI- NANCE NO. ......i.Q.L- OF THE CITY OF GILROY~ THE COMMON COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS : SECTION I: No fence shall hereafter be constructed, erected, or placed upon any property in a residential district in the City of Gilroy, that is upon property in an "A" or "Btt district as the same are defined Zoning Ordinance No. 422 of the City of Gilroy, except as follows: (a) Along any alley, the height of a fence shall not exceed seven (7) feet from the ground. (b) From the nearest alley line or rear property line tQ the front line of the main wall of the dwelling, the height of the fence shall not exceed six (6) feet, and if no dwelling, shall be of such height not exceeding six (6) feet as may be permitted by the Building Inspector of the City of Gilroy, the decision of the Building Inspector to be subject to the right of the applicant for a permit to appeal to the Common Council. (c) In all other cases, a fence shall not exceed three (3) feet in height. (d) In cases where rolled curb and gutters have been hereto- fore constructed and/or installed, a fence shall not be placed or constructed closer than twelve (12) inches from the inside of the sidewalk line but if the water service furnished the property is from the street along which the fence is constructed, the fence shall be constructed eighteen (18) inches or more from the inside line of the sidewalk. /'....- ~..~) " ) y / ~:~' J L[ SECTION II: No fence shall be hereafter erected in the City of Gilroy without a permit first obtained from the Building Inspector of the City of Gilroy, and the application for the permit shall show the location of the fence on a sketch, diagram, or platt of the property on which it is to be erected or placed, and the location and designation of the buildings thereon. Also the type of construction and the height of the proposed fences. SECTION III: Any person violating this ordinance or any part thereof shall be deemed guilty of a misdemeanor and upon conviction shall pay a fine or not in excess of $100.00 or be imprisoned in the city jail for a period of not more than thirty (30) days, or both such fine and imprisonment. SECTION IV: Any fence erected contrary to the provisions of this ordinance shall be removed upon the order of the Common Council. SECTION V: This ordinance shall be in full force and effect from and after its passage and approval. SECTION VI: All ordinances and parts of ordinances in con- flict herewith are hereby repealed.
