ORDINANCE NO._. ?~~___ ORDINANCE OF THE CITY OF GILROY AMENDING SUBDIVISIONS 10 AND 14 OF SECTION NO. 22 OF ORDINANCE NO. 452 BY ADDING THERETO PROVISION THAT NO LICENSE BE ISSUED TO OPERATE OR CONDUCT CARD ROOMS, BILLIARD AND/OR POOL HALLS, OR BAGATELLE HALLS WITHOUT APPROVAL OF COMMON COUNCIL. THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO HEREBY ORDAIN AS FOLLOWS: SECTION ONE: Subdivision 10 of Section 22 of Ordinance Number 452 of the City of Gilroy is hereby amended to read as follows: 10. Billiards, Pool and Bagatelle. For the business of conducting billiara, pool or bagatelle halls, where no merchandise is sold, $2.50 per quarter, per table. For the business of conducting billiard, pool or bagatelle halls, with the sale of merchandise in conjunction therewith, $40.00 per year. No license for the conducting of any pool hall or bagatelle hall, shall be issued by the license collec- tor without the approval of the City Marshall and the City Marshall shall not approve any such license unless and until the application for the license shall have been first submitted to the Common Council and the granting of the license approved by said Council; the License Collector shall investigate all applica- tions for licenses in this subsection provided for and. submit a report and recommendation thereon to the Common Council which may make an independent investi- gation; no such license shall be issued to any appli- cant who is not of good moral character or where the issuance of the license would be detrimental to public morals or the public welfare. SECTION TWO: Subsection 14 of said section 22 of said Ordinance Number 452 is hereby amended to read as follows: 14. Card Rooms. For the business of conducting a Card Room, $100.00 per year, for one table, and $50.00 per year for each additional table. This license shall be issued only for the game known as "California Draw Poker II . No license for the conducting of any card room shall be issued by the License Collector without the approval of the City Marshall and the City Marshall shall not approve any such license unless and until the appli- cation for the license shall have been first submitted to the Common Council and the granting of the license approved by said Council; the License Collector shall investigate all applications for licenses in this subsection provided for and submit a report and re- commendation thereon to the Common Council which may make an ~ndependent investigation; no such license shall Q'2?/ T be issued to any applicant who is not of good moral character or where the issuance of the license would be detrimental to public morals or the public welfare. SECTION THREE: All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. SECTION FOUR: This ordinance shall take effect and be in full force from and after its passage and approval.
