B ~ I N !l N Q ~ # 591 A~ ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING THE NORTHirJESTERlY T1NENTY-TWO (22) FEET OF A TEN FOOT ALLEY OR RIGHT OF 'NAY, THE CENTER LINE OF 1tJHICH IS THE LINE DIVIDING LOTS 53 AND 54 ON TRACT NO. 1784 SHERWOOD PARK UNIT NUMBER ONE. . XHE COMMON COUNCIL OF THE CITY OF GILROY having on the 17th . , day of No~ember, 1958, duly passed and adopted Ordinance .5g7 whereby it declared its intention to proceed, under the Street Vacation Act of 1941, and vacate a certain street, public alley, or thorough- fare in the City of Gilroy hereinafter described. And, the City Clerk of the City of Gilroy having caysed .notices of the passing of said Ordinance to be published in The Gilr~y Evening Iispatch, a newspaper of general circulation, in the manner and form required bt law; an~ the said street, puhJic alley, or thoroughfare having been posted in the manner and form required by law; and no objection to said proposed vacation of said street, public alley or thoroughfare having been filed at or before the hearing held by said council on the 15th day of December, 1958, at 8:00 P.M. o'clock, at the Common Council Chambers in the 1^,heeler Municiual Auditoriu~, at Sixth and Rosanna Streets, in the City of Gilroy, California, and the said Common Council having duly considered the matter of vacating the said street, public alley or thoroughfare, which is hereinafter described: THE HAYOR AND CO!'-fMON COUNCIL OF THE CITY OF GIlROY DO ORDAIN AS FOLLOWS: SECTION I: The following described street, public alley within the said City is hereby vacated and abandoned: All of the following described alley, or right of way or easement: The Northwesterly twenty-two (22) feet of a strip of land of a uniform width of ten (10) feet, the center line of which is the line dividing Lots 53 and 54 of Traet No. 1784 Sherwood Park Unit No.1, as shown upon the map thereof on record in the County Recorder's Office of Santa Clara County, in Map Book 71, pages 28 and 29. /, , -) '/ , / '------'- r SECTION II: The vacation and abandonment of the said alley or right of way or easement hereinbefore described shall in no way affect the right of way, if any, in said alley, right of way or easement now held by the Pacific Telephone and Telegraph Company as set forth in the right of way agreement now of record with the Recorder of Santa Clara County, or any right of way heretofore granted to the Pacific Gas and Electric Company or its predecessor at interest, the Coast Counties Gas ano Electric Company or of the City of Gilroy to repair or rep'ace any water, drainage or sewer lines now in or on said uremises. SECTION III: The Ordinance shall take effect and be in force from and after the date of its passage and auproval. ADOPTED A~~ PASSED this l5thday of December, 1958, by the following votes.
