NO. 594__
AN ORDINANCE OF THE CITY OF GILROY VACATING AND
ABANDONING A RIGHT OF WAY OR EASEMENT HERETOFORE
DEDICATED TO THE CITY OF GILROY
WHEREAS there has heretofore been accepted by the Common
Council of the City of Gilroy a map of a subdivision known as
Castlewood Park Unit No.3, and the map or plat of said subdivi-
sion has been duly recorded in the Office of the County Recorder
of the County of Santa Clara: and
WHEREAS there is shown on the said plat a public utility
easement over a strip of land of a uniform width of four (4) feet,
the center line of which is the line dividing Lots 4 and 5 of said
Castlewood Park Unit No.3, and said easement has been dedicated
to the public: and
WHEREAS application has been made to the Common Council
of the City of Gilroy to close or abandon the said public utility
easement upon the condition that another similar easement, four (4)
at
feet wide, the center line of which shall be located;tne uniform
distance of seven (7) feet southeaster~Ofthe line dividing said
Lots 4 and 5, be dedicated to the public for public utility purposes:
and
WHEREAS the said easement first above described, the center
line of which is the line dividing Lots 4 and 5, will not be neces-
sary, or required, or benefit any property nor the public if the
other easement is g.di~..ed, and no good reason exists why the
application to abandon the said easement should not be granted, and
WHEREAS notice of the hearing to abandon the said easement
has been given in the manner and for the period required by law, by
publication and by posting, and no objection to the said proposed
abandonment having been made or filed:

AS FOLLOWS:
SECTION I. The following described easement, being that
hereinbefore mentioned, within the City of Gilroy, is hereby
vacated and abandoned, to wit:
A public utility easement over a strip of land
of a uniform width of four (4) feet, the center line
of which is the line dividing Lots 4 and 5 of
Castlewood Park Unit No. 3 as shown on the official
map thereof on record in the Office of the County
Recorder of Santa Clara County.
SECTION II. The City Clerk is hereby directed to have a
certified copy of this Ordinance recorded in the Office of the
County Recorder of Santa Clara County, California, immediately
upon its becoming effective.
SECTION III. This Ordinance shall take effect and be in
full force from and after the dedication to the public of the
public utility easement hereinbefore mentioned which is to take
the place of the easement abandoned.
ADOPTED AND PASSED this 5th day of January, 1959, by the
following vote:
