THE SYSTENATIC COLlECTION OF GARDEN REFUSE; DEFnnNG AND PROHIBITING THE PLACnrG OF OTHER REFUSE ON THE STREETS OR AREAS BETWJ1'EN Tim STREETS AND SIDEWALKS AND PROHIBITING THE PLACING OF ANY REFUSE, GARBAGE OR RUBBISH RECEPl'AClES OR OTHF'R EA- TERIALS IN ALLEYS. SECTION I It Garden Refuse" Def~ned The words I1garden refuse" as used herein shall mean and include leaves, grass cuttings, weeds, vines, shrubbery, brush and tree trimmings, but not tree limbs of over fOLtr (4) inches in diameter. SECTION II "other Refuse" Defined The words "other refuse" as used herein shall mean any rubbish or garbage or discarded materials other than garden refuse. SECTION III General Re~lations for Pla.cing of Garden Refuse a. Garden refuse may be placed by the abutting property owner -or''Oc..cupant or their agents on the street and in the area between the street and the side- walk or in a location designated by the Director of Public Works subject to the conditions set forth in Section ~ and Section 2 of this ordinance. b. It shall be unlawful to deposit "other refuse" in the street or in the area between the street and the sidewalk or sidewalk area. No garden 'refuse will be picked up by the City that is mixed with "other refuse". c. It shall be unlawful to deposit garden refuse or other refuse or to place garbage or rubbish receptacles or incinerators in alleys or to use alleys for storage of any materials. d. Tree surgeons and professional tree trimmers shall haul away and dispose of all tree trimmings and other garde~ refuse accumulated by them. j e. Where streets are paved from gutter to gutter leaves and lawn cuttings only may be placed in the street at any time subject to the provisions of Section it of this ordinance. Other garden refuse may be placed in the areas designated and under re- gulations set forth in Section!t and Sectionj of this ordinance on the day prior to the day of collection. The designation of the day of collection of garden refuse will be made by the Director of Public Works, who may divi- de the City into districts with different collection days designated for each district. Initial notice of the districts designated and collection days specified for said districts shall be by notification mailed with the water bills. Notice of any additional designation of districts or collec- tion days or any change of district designations or collection days shall be made in the same manner. SECTION IV . T,mnorar:v Placement of Garden Refuse Where Streets are Paved from Gutter to Gutter 1. Leaves and ass cutt only shall be placed in the street not less than twelve 12 inches and not more than forty-eight inches, from the curb so that they may be picked up with the street sweeper. 2. WeesIs, vines. shrubbe1"Y~ brush and tree trimm1n~s shall be placed in suitable containers or tied in bundles 'Whicb shall not exceed fifty (50) pounds in 'Weight or four feet in length. The containers or bundles shall be placed in the area between the sidewalk and the curb. In areas where the sidewalk abutts the curb the containers or bundles shall be placed on the lawn two feet from the sidewalk. If cardboard containers are used the containers will be hauled away with the contents and will not be returned. The con- tainers Shall be placed between the street and the sidewalk or sidewalk area. b. Weeds, vines, shrubbez;r, brush and tree tr~mmimts shall be placed in suitable containers or tied in bundles which shall not exceed fifty (;0) pounds in weight or four (4) feet in length. The containers or bundles shall be placed between the street and the sidewalk or sidewalk area or at a location desig- nated by the Director of Public 1;lorks. If cardboard containers are used they will be hauled away with the contents and will not be returned. SECTION VI Penalty Any person violating this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall pay a fine not in excess of one hundred dollars ($100) or imprisonment in the city jail for a period of not more than thirty (30) days, or both such fine and imprisonment. SECTION VI 'j;ffective Date This ordinance shall be in full force and effect from and after its passage and approval. SECTION vnlReooal All ordinances or parts of ordinances in conflict herewith are hereby repealed.
