Ordinance 619 T ---- ORDINANCE NOo 619 AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY OWNED BY THE CITY OF GILROYq DESIGNATED AS "GILROY SEWER FARM ANNEXATION NO.2" ~ UNDER THE ANNEXATION OF UNINHABITED TERRITORY ACT OF ~~39.0 AND FOR THE INCORPORATION OF SUCH TERRITORY IN AND AS A PART OF SUCH MUNICIPALITY FOR THE GOVERNMENT AND MUNICIPAL CONTROL OF SUCH ANNEXED TERRITORY. WHEREAS, the City of Gilroy is the owner of the premises hereinafter described and has been the owner of such territory from a time prior to the initiation of proceedings for the annexation of such territory; andr WHEREASq the Common Council of the City of Gilroy did~ on the 21st day of December~ 1959~ adopt Resolution # 551 wherein and whereby it did initiate proceedings to annex the said territory to the City of Gilroy as uninhabited territory owned by itz under the Annexation of Uninhabited Territory Act of 1939; and: WHEREAS. the description of the premises hereinbefore men- tioned and hereinafter described was~ prior to the adoption of said resolution number 551 of the Common Council of the City of Gilroy~ submitted to the Boundary Commission of the County of Santa Clara~ and the said Bounda~ Commission did report approving the definiteness and certainty of the boundaries of said territory; ande WHEREAS; the said Resolution Number 551 did find the foregoing as facts: and did further find that the total area of the aforesaid premises was less than One Hundred (100) acresq and did fix MondaYt the 15th day of February~ 1960q at the hour of 8:00 otclock Po Mo in the Common Council Chambers in the Wheeler Municipal Auditorium at 6th and Rosanna streets in the City of Gilroyz as the time and place of hearing of said proposed annexation~ which resolution complied with the provisions of the Uninhabited Territory Act of 1939; and~ WHEREASq Notice of the said hearing has been given as required by Section 35311 of the Government Cods; and~ WHEREASq The said Common Council of the City of Gilroy did hold the said hearing at the time and place specified in the aforesaid resolution and in the Notice of the hearing~ and no objections or protests to said annexa€ion were filed or made; and: WHEREAS. the said territory hereinbefore mentioned and here- inafter describedq being that described in the aforesaid Resolution Number 551~ at all times herein stated was and still is owned solely by the said City of GilroYq and during all the said perio~ has been v and still is used for a Municipal purpose and the area of said pre- mises is less than One Hundred (100) acres and said premises are eligible for annexation to the City of Gilroy under the provisions of Section 3520105 of the Government Code; and~ WHEREAS, all things required by law to be doner as a condition precedent to the annexation of said territory to the City of GilroYq have been done and accomplishedo NOW THEREFORE. THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY# DO HEREBY ORDAIN AS FOLLOWS: SECTION I: The said Common Council of the City of Gilroy " "\ ';'{, ~...,.:~-i/t ,. ,.:1 ,~, - - 1 - / " '. 1::"- /7 F II "I does hereby approve the annexation of the territory hereinbefore mentioned and hereinafter described to the City of GilroYr and does hereby further ordain that the said territory be and the same is hereby annexed to the City of Gilroyp The said territory, the annexation of which to the City of Gilroy is hereby approved and ordained~ is all ttlat territory situated in the County of Santa Claraq State of California~ and more particularly described as follows: BEING a portion of Las Animas Ranch Lot 51 as shown on Map Noo 7 accompanying the final report of the Referees in the Las Animas Rancho Partition Suitz Action No. 5536z had in the Superior Court of the State of Californiaz in and for the County of Santa Clara,. to wit: BEGINNING at a point on the Northwe~erly line of said Ranch Lot 51 as shown on said Map,. distant thereon No 570 47t Eo 1950.36 feet from the most westerly corner of said Ranch Lot 51 and running thence N 570 47t East along said line of said lot 2313.24 feet to the most Northerly corner thereof; thence S. 350 1St Eo 1659024 feet to the most easterly corner of said lot; thence So 540 45t Wo 2310 feet along the Southeasterly line of said Lot 51; thence No 350 15t W. 1781.67 feet to the point of beginning. SECTION II: The said lands hereby annexed to the City of Gilroy shall be known as I1GILROY SEWER FARM ANNEXATION NO. 211.
