Ordinance 629 - , ORDINANCE NO. 629 AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE. ANNEXATIONTHERETO OF CERTAIN mNI~ITED TERRITORY, TO BE KNOWN AS "JUNG EASTERN ADDITION" TO THE CITY OF GILROY I AND FOR THE INCORPORATION OF SUCH ANNEXED TERRITORY IN AND AS A PART OF SUCH MUNICIPALITY FOR THE GOVERNMENT AND MUNICIPAL CONTROL OF SUCH ANNEXED TERRITORY. WHEREAS, a written petition has heretofore been filed in the office of the City Clerk of theCity of Gilroy under the provi- sions of the "Annexation of Uninhabited Territory Act of 1939", as set forth within Sections 35300 to 35325 inclusive of the Govern- ment COde, asking that there be annexed to the City of Gilroy, as uninhabited territory, certain property located in the County of Santa Clara, therein and hereinafater more particularly described; and, WHEREAS, it appears that the said petition has been signed by the owner of all of the land in the territory sought tobe annexed by area, and that the said tract of land is contiguous to the present city limits of the City of Gilroy; and, WHEREAS, the proposal to annex the said territory to the City of Gilroy has re retofore been submitted to the Boundary Commission of the County of Santa Clara and the said Boundary Commission has reported approving the definiteness and certainty of the boundaries of the said territory; and, WHEREAS the said CounCil of the City of GilIOY did heretofore and on the 20th day of June, 1960, adopt Resolution No. 574 finding the foregoing as facts, and fixing Monday, the 18th day of July,1960, at the hour of 8:00 o'clock P.M. of said day, in the Counctl Chambers in the City Hall, Gilroy, California, as the time and place for the hearing of said petition and proposal to annex said territory, which Resolution complied with the provisions of Sections 35305 and 35306 of the Government Code; and, WHEREAS, notice of the said hearing has been given as required by Sections 35307 and 35311 of the said Government Code by publication of a copy of said Resolution in the Gilroy Evening Dispatch, a news- paper published in the said City of Gilroy, County of Santa Clara, as required by law and the previous order of the Council of the City of Gilroy, and also by the giving of a notice of the time and place of the hearing by the City Clerk of the City of Gilroy to each person to whom land lying within the District proposed to be annexed is assessed in the last equalized County Assessment Roll at the address shown or as known to the said City Clerk; and, WHEREAS, the said Council of the City of Gilroy has now held the said hearing, and no objections or protests to said propoBed annexation having been filed on or before the time of the said bearing as fixed in the aforesaid Resolution and notice, and the said Council having duly considered the matter of said annexation and deeming it desirable and for the best interests of tbe said City of Gilroy that the said territory be annexed to the said City of Gilroy. -1- jp ~ ....../ &Jl ,I' c; ,'l t- t NOW,THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES HEREBY ORDAIN AS FOLLOWS; SECTION I: Under the authority of the said "Uninhabited Territory Act of 1939", as set forth in Sections 35300 to 35326 of the Govern- ment Code of the State of California, the same bang Chapter 297, Statutes of 1939 and amendments thereto, there is hereby annexed to the said City of Gilroy as uninhabited territory, the property and premises hereinbefore mentioned which are more particularly described as follows: All that certain real property situate in the County of Santa Clara, State of California, described as follows: BEGINNING at a 6" x 8" white post marked "Gilroy Limits" standing at the point of intersection of the North line of Old Gilroy Street with the Eastern City Limits, and running thence along the said Eastern City Limits of the City of Gilroyjn a Northwesterly direction, 336.60 feet to the line between Sublots 19 and 19A; thence along the mid line between said Sublots 19 and 19A North 570 55' E. 5.77 Chains to a 4" x 4" white post marked H. 3.M; thence South 320 5' East 8.69 chains to a 4" x 4" white post marked H. 2.M. an~ South 380 30' West 2.00 chains to a 4" x 4" white post marked H.l.M. and being the common corn~t for Ranch Lots 42 and 40 in the North line of Old Gilroy Road, and thence along said North line of said Old Gilroy Road, the follow- ing course s and distances; North 510 30' West 1.90 chain'.'t,ooh8l'4""x 4" white post marked B.O.R. North 560 16' West 0.38 chains, North 650 56' West 0.38 chains, North 75" 36' West 0.38 chains and North 850 16' West 0.38 chains to a 4'1 x 4" post marked B.O.R. and being Western end of first or Western corner of said Old Gilroy Road, and Thence still along said North line of said Road, South 890 54' West 4.38 chains to the point of beginning,and being designated on Maps No. 7 and 8, accompanying the Final Report of the Referees as Sub Lot 19 and Ranch Lot No. 42 in the Partition Action of the Las Animas Ranch in the Superior Court of the State of California, in and for the County of Santa Clara, entitled Henry Miller et al, vs. Massey Thomas, et al, Action No. 5536. EXCEPTING THEREFROM all that certain real property situate in the County of Santa Clara, State of California described as follows: BEGINNING at a 4" x 4" white post marked H.M.l set on the Northeasterly line of Old Gilroy Road at the Southernmost corner of that certain 5.67 acre tract of land described in the Deed from Andreo Repetto et ux, to Agostino Rocchi, et ux, dated October 31,1936 and recorded November 23, 1936 in Book 798 of Official Records, page 265, Santa Clara County Records; thence from said point of beginning Narth 510 30' West along the said Northeasterly line of Old Gilroy Road 66.00 feet to a 4" x 4" white post marked B. O. R; thence continuing along the said Northeasterly line of Old Gilroy Road, North 56- 16' West 9.00 feet; thence North 380 30' East and parallel with the South-easterly line of said 5.67 acre tract and it's Northeasterly prolongation 159 feet more or less, to a point on the Northeasterly line of said 5.67 a~re tract; thence south 320 05' Eastalong said last named line, 80 feet, more or less, to a 4" x 4" white post marked H. 2.M., set at the Easternmost corner of said 5.67 acre tract; thence South 380 30' West along said Southeasterly line of 5.67 acre tract 132000 feet to the point of beginning. -2- SECTION II: The said lands hereby annexed to the City of Gilroy shall be known as "JUNG EASTERN ADD IT ION II . SECTION III: This ordinance shall take effect and be in full force from and after the date of the filing of a certified copy of this ordinance in the office of the Secretary of State.
