ORDINANCE NO. 653
AN ORDINANCE AMENDING SECTION 13.1 OF ARTICLE 13 OF THE
FIRE PREVENTION CODE (EDITION OF 1960) AS ADOPTED BY
ORDINANCE NO. 639 OF THE CITY OF GILROY BY ELIMI-
NATING THE WORD "SPARKLERSR FROM SAID S.ECTION.
THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
Section 1.
Section 13.1 of Article 13 of the Fire Preven-
tion Code, Edition of 1960, as heretofore adopted by the
Council of the City of Gilroy by Ordinance No. 639
is hereby amended to read as follows:
Section 13.1. Definition.
Fireworks shall mean and include any combustible
or explosive composition, or any substance or
combination of substances, or article prepared
for the purpose of producing a visible or an
audible effect by combustion, explosion, defla-
gration or detonation, and shall include blank
cartridges, toy pistols, toy cannons, toy canes
or toy guns in which explosives are used, the
type of balloons which require fire underneath
to propel the same, firecrackers, torpedeos,
skyrockets, Roman candles, Daygo bombs, or other
devices of like construction and any devices
containing any explosive or flammable compound,
or any tablets or other device containing any
explosive substance, except that the term Rfire-
works" shall not include auto flares, paper caps
containing not in excess of an average of twenty-five
hundredths of a grain of explosive content per cap,
and toy pistols, toy canes, toy guns or other de-
vices for use of such caps, the sale and use of
which shall be permitted at all times.
Section 2. Repeal.
All ordinances and parts of ordinances in conflict
with this ordinance are hereby repealed.
Section 3. Effective Date.
This ordinance shall take effect and be in full force
thirty (30) days from and after its adoption and approval.
