Ordinance 656 '., '~- ORDINANCE NO. 656 AN ORDINANCE OF THE CITY OF GILROY REPEALING SECTION 5.4 AND AMENDING SECTIONS 5.6, 5.7, 5.9, 5.10, AND 5.11 OF THE GILROY CITY CODE PERTAINING TO THE REG1S- TRATION, REGULATION AND LICENSING OF BICYCLES. THE CQUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLQWS: SECTION 1. Sect i on 5.4 of the Gilroy City Code is hereby repea 1 ed. SECTION 2. Sections 5.6, 5.7, 5.9, 5.10, and 5.11 are hereby amended to read as follows: Section 5.6 REMOVAL DESTRUCTION, ETC. OF LICENSE PLATES, SEALS, IDENTIFYING NUMBERS, OR REGISTRATION CERTIFICATES: CHIEF OF POLICE MAY STAMP BICYCLES. It shall be unlawful for any person to willfully remove, destroy, mut- ilate or alter, or cause or permit to be removed, destroyed, mutilated or altered any license plate issued by or on behalf of the City for allY such bicycle or any seal or registration certificate, or identifying number rela- ting to such bicycle during the time in which such license plate, seal, iden- tifying number or registration certificate is operative; provided, however, that nothing in this chapter shall be deemed or construed to prohibit the Chief of Police from stamping any number on any such bicycle for identifica- tion purposes. Section 5.7 LICENSE-REQUIRED; PROCUREMENT; FEE EXEMPTION; RENEWAL; DURATION. It shall be unlawful for any person to operate or use, or cause or permit to operate or Use any registered bicycle in, along or across any public highway in the City unless there shall have been first obtained by or on behalf of the owner of such bicycle a I icense to do so, which license shall be procured from the Chief of Police, and for which the applicant shall have paid a license fee in the sum of fifty cents. The provisions of this section shall not apply to any bicycle owner not a resident of the City of Gilroy, provided the bicycle owned by him has affixed thereon a valid, unex- pired license of any city or county within the State of California. Each such 1 i cense sha 11 be subj ect to renewa I whenever the ownersh i p of the bicycle changes. Each such license when so issued shall entitle the licensee to OPerate such bicycle for the remainder of the period for which the license has been issued. Each license period shall be three y~rs. The first license period shall begin on January 1, 1962 and shall end December 31, 1964. A new application for a license shall be filed and a new license obtained prior to the fifteenth day of the first January of each license Period. Section 5.9 SAME - LICENSE PLATES; SPECIFICATIONS; TRANSFER. The Chief of Police shall provide for each bicycle, licensed pursuant to this chapter, a license plate, which plate shall be serially numbered for each identifying letter, commencing with number one, and the ni;lme "GILROY" stamped thereon. Ei;lch such license plate shall be suitable for attachment upon the frame of the bicycle for which issued; it shall be the duty of the licensee to immediately attach such license plate to the frame of the parti- cular bicycle for which issued, and no person shall transfer or cause or permit to be transferred any such license plate to any bicycle for which the same shall not have been originally issued. Section 5.10 SAME - LICENSE PLATE REQUIRED TO BE ATTACHED; BICYCLE MUST BE REGISTERED PRIOR TO ISSUANCE OF LlCENSE; IMPPUND[NG OF UN- to5(p -1- LICENSED BICYCLES; LICENSE FEE FOR IMPOUNDED BICYCLES. No person shall operate any bicycle on, along or across any public highway in the City unless the license plate issued therefor is maintained upon such bicycle for which issued and attached thereto; provided however, that no license provided for under the provisions of this chapter shall be issued by the Chief of Police until the blcyc~e described therein has been registered by the Chief of Pol ice. The Chief of Pol ice inay Impound and re- tain possession of any bicycle that does not have affixed thereon a valid, unexpired license plate until such time as the owner thereof shall have ob- tained a license under the provisions of this chapter. The license fee for 'impounded bicycles shal I be one dollar. Section 5.11 SAME - ISSUANCE TO NEW OWNERS; WRITTEN TRANSFER OF TITLE REQUIRED. Upon the sale or transfer of title or any such bicycle licensed pur- suant to the provisions of this chapter, the purchaser or transferee thereof, upon the payment of the sum of fffty cents to the Ch i ef of Po lice, sha 1 I be entitled to have a license issued for such bicycle In the name of the new owner thereof. Each app I I cat i on for such a license sha I I be made to the Chief of Police in writing, shall be accompanied by a written transfer of title and shall describe such bicycle in sufficient detail to identify the same and shall include the serial number, letter or other identifying mark existing thereon.
