Ordinance 668 '" ORDINANCE NO. 668 EMERGENCY OR INTERIM ORDINANCE CRDERING AND DIRECTING THAT NO BUILDING PERMITS BE ISSUED FOR DWELLINGS OR OTHER STRUCTURES IN THE CITY OF GILROl WHICH DO NOT COMPLY WI'rH THE RULES AND REGU- LATIONS IN PROPOSED ORDINANCE NOW PENDING BEFORE THE COUNCIL OF THE CITY OF GILROY, DEFINING AND DESCRIBING "S" DISTRICTS. WHEREAS, the Council of the City of Gilroy has heretofore amended Ordinance No. 422 of said City, known as the Zoning Ordi- nance, by adopting Ordinance No. 662 which authorizes the creation of "SIt or combining districts to include areas in other districts for the purpose of providing regulations for site control, parking and other development requirements; and, WHEREAS, the Planning Commission of the City of Gilroy has proposed on its own initiative that said Zoning Ordinance be further amended by establishing and defining the exact areas which shall comprise and be included in said ItSIt Districts and has duly reported to the Council its recommendation that all of the City of Gilroy, except that portion thereof, in ItA" and "EIt Districts as the same are de- fined in said Zoning Ordinance, be included in and form said "SIt Districts;~nd, WHEREAS, it is necessary that the Council consider the adoption of said proposed ordinance as recommended by the said Planning Com- misSbn and to hold public hearings thereon, all of which will take a considerable length of time, during which the said ordinance will be largely circumvented by applications for, and granting of building permits authorizing the erection of dwellings and structures which will not conform to, but be in violation of said ordinance, if adopted; and, WHEREAS, it appears that the adoption of saidproposed amend- ment to said Zoning Ordinance will be for the public welfare and in the interest of public safety because it will tend to prevent the increase of the parking of vehicles upon the public streets and the increase of vehicle ~ongestion and traffic hazards by requiring each building and structure which will be erected after the adoption of 1 - (ptp 8 the ordinance to have sufficient off-street parking facilities for its needs and will tend to the orderly development of the City, and no building permits should be issued during the time the Council is con- sidering and acting upon the proposed amendment and before the said amendment, if adopted, takes effect, which will be contrary to the provisions of said proposed amendment; , NOW, THEREFORE, the Council of the City of Gilroy does ordain as follows: Section 1. No permit shall be issued for the construction or erection of any dwelling or other building or of any addition thereto in any nBII, "CII ,IIC-1I1, or nDII District or Zone in the City of Gilroy, as the same are defined and established by Ordinance No. 422 of the City of Gilroy and amendments thereto, which does not conform to t he regulations set forth in said Ordinance No. 662 of the City of Gilroy, authorizing the establishment of liS" Districts in said City and providing the rules and reguh tions governing said IISn Districts or upon any premises in the City of Gilroy which do not conform to said rules and regulations, until the said Council has held hearings upon and considered the proposed amendment to said zoning ordinance establishing the areas to be included in said nSn Districts, and the said amendment has been adopted by the Council and becomes effective or the Council has refused to adopt said amend- ment, provided however, that the foregoing restriction upon the issuance of building permits shall not extend beyond the 17th day of January , 192L-. Section 2. This ordinance is adopted as an interim and emer- gency ordinance. The facts showing that such an emergency exists are those set forth in the prea.IDb1e to this ordinance which the Council now finds to be true and hereby adopts, and in addition thereto, the Council declares and finds that the adoption of the ordinance will promote the public safety and welfare, will prevent the construction of buildings that will not conform to the regulations set forth in - 2 - the proposed ordinance reported to the Council by the Planning Commission and will also prevent the circumvention of the Ordinance through the construction of buildings while the Council is consider- in9 the adoption of the Ordinance, and that this Ordinance therefore, shall take effect and be in full force immediately upon its passage and approval.
