AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING A PORTION OF WELBURN
AVENUE
THE COUNCIL OF THE CITY OF GILROY having heretofore and on the 5th day
of November, 1962, duly passed and adopted Resolution No. 711 whereby it declared
its Intention to proceed, under the Street Vacation Act of 1941, to vacate a
certain street In the City of Gilroy hereinafter described.
And, the City Clerk of the City of Gilroy having caused notices of
the passing of said ordinance to be published in The Gilroy Evening Dispatch, a
newspaper of general circulation, in the manner and form required by law; and
the said street, public alley, or thoroughfare having been posted In the manner
and form required by law; and no objection to said proposed vacation of said
street, public alley or thoroughfare having been filed at or before the hearing
held by said Council on the 19th day of November, 1962, at 8:00 o'clock P.M.,
at the Council Chambers in the Wheeler Municipal Auditorium, at No. 10 South
Rosanna Street, in the City of Gilroy, California the time and place fixed
for the hearing in the said notices, and the Council having duly considered
the matter of vacating the said street, publ ic alley or thoroughfare, which is
hereinafter described:
NOW THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. The following described portion of Welburn Avenue here-
inbefore mentioned, within the said City of Gilroy is hereby vacated and aban-
doned:
BEING a portion of Welburn Avenue as shown on map entitled '~ract
No. 1784, Sherwood Park, Unit No. 1", which map is recorded in
Book 71 of Maps at pages 28 and 29, Records of Santa Clara County,
California, and being more particularly desaribed as follows:
"BEGINNING at a point in the northwesterly line of Welburn Avenue
as shown on said map, distant thereon S. 700 W. 52.14 feet from
the intersection thereof with the southwesterly line of Doris
Court, and running thence along the southerly line of Lots 63 and
64 along a curve to the right with a radius of 100.00 feet and
a central angle of 200 45', for a distance of 36.22 feet; thence
along a curve to the right with a radius of 20.00 feet and a cen-
tral angle of 770 00', for a distance of 23.39 feet to a point

in the northeasterly line of Wayland Lane; thence along a projec-
tion of the northeasterly line of Wayland Lane as shown on said
map S. 220 IS' E. 42.99 feet; thence along a curve to the left
with a radius of 20.00 feet and a~entral angle of 920 15', for
a distance of 32.20 feet to a point in the projected southeasterly
line of Welburn Avenue as shown on said map; thence along said
southeasterly line N. 700 E. 137.76 feet to the point of begln-
ning.1t
SECTION II: The vacation and abandonment of the said alley or
right of way or easement hereinbefore described shall in no way affect the
right of way, If any, in said alley, right of way or easement now held by
the pacific Telephone and Telegraph Company as set forth in any right of way
agreement now of record with the Recorder of Santa Clara County, or any
right of way, if any, heretofore granted to the Pacific Gas and Electric
Company or its predecessor at interest, the Coast Counties Gas and Electric
Company or of the City of Gilroy to repair or replace any water, drainage or
sewer lines now in or on said premises.
SECTION III: The Ordinance shall take effect and be in force
30 days from and after the date of its passage and approval.
