Ordinance 701 ORDINANCE NO. 701 AN ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCES OF THE CITY OF GILROY BY ORIGINALLY ZONING TERRITORY DESIGNATED AS "WESTWOOD ACRES", a SUB-DIVISION NOT HERETOFORE ZONED The Council of the City of Gilroy does ordain as follows: SECTION 1. WHEREAS KENTWOOD DEVELOPMENT CORP., Inc., a corporation, has heretofore filed a verified application with the Planning Commission of the City of Gilroy to amend the Zoning Ordinances of said City of Gilroy by originally zoning the following des- cribed portion of the premises recently annexed to the City of Gilroy designated as WESTWOOD ACRES as "C-l" or Commercial District or Zone: BEING A portion of r.ots 5 and 6 as S'hown on Map entitled "Map of a Subdivis ion of the Lands of S. P. Fine in the Solis Rancho", which Map is recorded in Book "F-2" of Maps, at page 46, Records of Santa Clara County, California, and being more particularly described as follows: "BEGINNING at a point in the line common to Lots 5 and 6 distant thereon, S. 40 35' W. 20.30 feet from an iron pipe at the corner common to Lots 5 and 6 in the southerly line of the Hecker Pass Highway (shown as Bodfish Mill Road on said Map) and running thence along said common line S. 40 35' W. 516.95 feet~ thence N. 880 45' E. 163.00 feet~ thence N. 40 35' E. 526.72 feet~ thence N. 850 21' 14" E. 148.39 feet~ thence along a curve to the right having a radius of 945.00 feet and a central angle of 30 23' 46", a distance of 56.01 feet to the intersection of the southerly line of Hecker Pass Highway and the southeasterly line of Lot 6~ thence along said lot line S. 00 56' W. 737.65 feet and S. 150 40' 15" W. 115.00 feet~ thence N. 740 19' 45" W. 587.99 feet~ thencp N. 40 30' E. 657.33 feet to a point from WhIch an iron pipe in the southerly line of Hecker Pass Road bears N. 40 30' E. 22.11 feet~ thence parallel with said Hecker Pass Road, N. 880 45' E. 128.25 feet~ thence along a curve to the left having a radius of 1055.00 feet and a central angle of 30 21' 51", a distance of 61.95 feet to the point of beginning, and CONTAINING THEREIN 8.037 acres of land."~ and -1- l70/ 'i': THAT the following des.cribed portion of said WESTWOOD ACRES be zoned as multiple or Zone "BII District: IIBEGINNING at a point in the line common to Lots 4 and 5, distant thereon S. 40 30' W. 915.82 feet from an iron pipe in the southeasterly line of Hecker Pass Road (formerly Bodfish Mill Road) as shown on said Map, and running thence along said common lot line, N. 40 30. W. 2060.00 feet~ thence along a curve to the ~ight from a tangent bearing of S. 730 221: 30" E. with a radius of 1050.00 feet and a central angle of 210 06' 40" for a distance of 386.88 feet~ thence S. 520 25t 50" E. 120.20 feet to a point in the southeasterly line of said Lot 6~ thence along said lot line, N. 150 40. 15" E. 2198.52 feet~ thence N. 740 19. 45t1 W. 598.93 feet~ thence N. 850 30. W. 294.47 feet to the point of beginning, and CONTAINING THEREIN 32.819 acres of landlt~ and WHEREAS the said Planning Commission has duly heard the said petition for said zoning, after due and legal notice of the said hearing has been given as required by the Zoning Ordinances of the City of Gilroy and as required by law, and has duly reported to the Council upon the said hearing in which it recommends that the said petition be granted~ and WHEREAS the Council of the City of Gilroy has heretofore fixed Monday, the 1st day of July, 1963, at the hour of 8 o'clock p.m., in the Council Chambers in the City Hall, No. 10 S. Rosanna st., Gilroy, California, as the time and place for hearing the -2- .' report of the said Planning Commission upon said proposed zoning, and the said report now coming on to be heard by the Council at said time and place so fixed and the Council having duly considered the same and having determined that the said r~port of the Planning Commission should be adopted, and that the said premises hereinbefore described should be zoned in accordance with the said application of the said KENTWOOD DEVELOPMENT CORP., Inc., and the said report of said Planning Commission~ NOW, THEREFORE, the Council of the City of Gilroy does ordain as follows: SECTION 1. Zoning Ordinance of the City of Gilroy is hereby amended by zoning the territory hereinbefore described forming WESTWOOD ACRES, in accordance with the said ~pplication, and that the portion of the premises hereinbefore described, for which application was made to have the same zoned as Zone C-l District, is hereby zoned as "C-l" District~ and that the portion hereinbefore described of said WEST- WOOD ACRES, for which application was made to have the same zoned as Zone B District, be and the same is hereby zoned "B" District~ and that the premises hereinbefore described, for which application was made to have the same zoned "A" District, be and the same is hereby zoned "A" District. SECTION 2. That each of the premises hereinbefore described be added to and become a part of the respective zone in which it is herein placed and the zoning map of the City of Gilroy be changed and amended to conform to this Ordinance.
