ORDINANCE NO. 702 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 15.67, 15.88, 15.90, 15.91 and 15.93 OF THE CODE OF THE CITY OF GILROY RELATING TO THE LENGTH OF TIME CONT INUOUS PARKING UPON STREETS OR ALLEYS IS PERMITTED~ PROVIDING FOR AN EXCEPTION TO SAn> REGULATIONS ON CERTAIN STREETS, PROVIDING FOR THE MARKINGS FOR LOADING ZONES, SETTING FORTH THE MEANINGS OF CURB MARKINGS, FORBIDDING THE VIOLATION OF SUCH SECTIONS, REQUIRING PERMITS FOR PARKING IN AN ALLEY FOR DELIVERY OR LOADING OR UNLOADING BETWEEN CERTAIN HOURS The Council of the City of Gilroy does ordain as follows: SECTION. I: Sec. 15.67 of the Gilroy City Code is hereby amended to read as follows: Sec. 15.67 Parking for more than one hundred and twenty hours prohibited~ exception. No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street or alley for more than a period of one hundred and twenty consecutive hours. In the event a vehicle is parked or left standing upon a street in excess of one hundred and twenty consecutive hours, any member of the police departmet authorized by the chief of police may remove such vehicle from the street in the manner and subject to the requirements of sections 22650-22652 and 2285d~ 22854 of the State Vehicle Code. The provisions of this section shall not apply to the owner or lessee of a residence, living in or occupying a dwelling situated on either side of Eigleberry Street between Fourth Street and Sixth Street or on the east side of Railroad Street between Old Gilroy Street and Lewis street, in cases where there is no garage or other parking area or facilities available for a motor vehicle upon the dwelling property. -1- 7{);!J Where there are no parking facilities available, the owner or operator of a motor vehicle shall nevertheless, be restricted as provided in the preceding paragraphs of this section, unless and until he obtains a permit from the city police department, which shall be attached to the vehicle, authorizing the unre- stricted parking of such vehicle on the portions of Eigleberry and Railroad Streets described in this section. Application for such a permit must be made in writing and shall only be granted by the police department after an inspection of the premises involved. SECTION II: Sec. 15.88 of the Gilroy City Code is hereby amended to read as follows: Sec. 15.88 Same -- To be indicated by yellow paint 1 ines . Loading zones shall be indicated by yellow pa~nt lines upon the top and side of the curb or upon the pavement if there is no curb. SECTION III: Sec. 15.90 of the Gilroy City Code is hereby amended to read as follows: Sec. 15.90 Curb markings -- Authority, meaningo The City Administrator is hereby authorized, subject to the provisions and limitations of this chapter to place, and when required by this Chapter or other ordinance of the city shall place, the following curb or pavement markings to indicate parking or standing regulations and such markings shall have the meanings as set forth: Red. No stopping, standing or parking at any time except as permitted by the state Vehicle Code and except that a bus may stop in a red zone marked or signed as a bus zone. Yellow. No stopping, standing or parking at any time -2- between 7:00 A.M. and 6:00 P.M. of any day except Sundays and holidays for any purpose other than the loading or unloading of passengers which shall consume less than three minutes or the loading or unloading of materials which shall consume less than twenty minutes. I White. No stopping, standing or parking for any purpose ether than loading or unloading of passengers which shall not exceed three minutes and such restrictions shall apply between 7:00 A.M. and 6:00 P.M. of any day except Sundays and holidays and except as follows: When such zone is in front of a hotel, the restrictions shall apply at all times. When such zone is in front of a theater, the restric- tions shall apply at all tine s except when such theater is closed. Green. No standing or parking for longer than ten minutes at any time between 7:00 A.M. and 6:00 P.M. of any day except Sundays and holidays. SECTION IV: Sec. 15.91 of the Gilroy City Code is hereby amended to read as follows: Sec. 15.91 - Same - Not to be Violated. When the City Administrator as directed under this chapter has caused curb or pavement markings to be placed, no person shall stop or stand or park a vehicle adjacent to any such legible curb marking or within such legible pavement markings in violation of any of the provisions of the preceding section SECTION V: Sec. 15.93 of the Gilroy City Code is hereby amended~,to read as fol.lows: -3- Sec. 15.93 Limitations on use of yellow loading zones; exception. Regardless of the restrictions and limitations regulating the use of yellow loading and unloading zones set forth in the preceding sections, where the owner or lessee of business property has no area on the property for parking facilities the owner or lessee may park a service or delivery vehicle within an alley loading zone between the hours of 7:00 A.M. and 6:00 P.M. for unlimited periods of time. The owner or lessee of the business property shall nevertheless be required to obtain a permit from the police department to park his service or delivery vehicle within such loading zone. Such permit parking shall be granted only after in- vestigation of the premises and the establishment of a need for such vehicle. When such a parking permit has been granted the permit shall be attached to the vehicle in such a manner as to be in plain view of a traffic officer. Yellow loading zones in alleys may also be used by vehicles of clients or business customers for the loading of purchases, subject to the time limit set forth in Section 15.90. SECTION VI: All ordinances and parts of ordinances in conflict herewith are hereby repealed.
