ORDINANCE OF THE COUNCIL OF THE CITY OF GILROY
UPHOLDING THE APPEAL FROM THE DECISION OF THE
PLANNING COMMISSION ON THE PETITION OF HAROLD
STEINMETZ AND OTHERS FOR REZONING FROM Cl DIS-
TRICT TO R3 DISTRICT THE PREMISES CONSTITUTING
ALL THAT PORTION OF BLOCK 1 SOUTH RANGE 2 WEST
OF THE CITY OF GILROY LYING EASTERLY OF THE
ALLEY EXTENDING THROUGH SAID BLOCK, EXCEPT AS
TO THE PREMISES BELONGING TO ELMER YOUNG, EFFIE
WELDON AND LAURENCE OSBORN CONSTITUTING THE
NORTHERLY PORTION OF THE SAID AREA, WHICH SHALL
REMAIN IN A Cl DISTRICT
WHEREAS, HAROLD STEINMETZ and others have heretofore peti-
tioned the Planning Commission of the City of Gilroy to change
the classification of all that portion of Block 1 South of Range
2 West of the City of Gilroy lying easterly of the alley extending
through said block from Cl Zone or District to R3 Zone; and
WHEREAS, the said Planning Commission has duly caused notice
of the hearing of said petition to be given in accordance with
the zoning ordinance of the City of Gilroy and in accordance with
the law of the State of California, and has held the said hearing
and has filed with the Council of said City its report upon said
application in which it finds and recommends that the petition
for said re-classification be not granted for the reasons set
forth in said report; and
WHEREAS, the said applicants have heretofore appealed from
the decision of said Planning Commission to the Counci I in accord-
ance with the provisions of the Zoning Ordinance of the City of
Gilroy and the said Council has heretofore fixed Monday, the 17th
day of August, 1964, at the hour of 8 olclock, p.m., in the
Counc i 1 Chambers in the City Ha 11 at No. 10 South Rosanna Street,
Gilroy, California, as the time and place for hearing said appeal,
and notice of the said hearing has been given as required by the
Zoning Ordinance of the City of Gi lroy and the law of the State
of California, which notice stated that if the Council approved
the said petition it would, at the same time, amend the Zoning
Ordinance of the City of Gilroy to re-classify the said designated

territory, as prayed for in the said petition; and
WHEREAS, said hearing has been regularly continued to the
8th day of September, 1964, at the hour of 8 o'clock, p.m., in
the Counc i I Chambers in the City Ha II at No. 10 South Rosanna
Street, Gilroy, California; and
WHEREAS, the Council has now heard the said appeal and the
evidence presented in support of the said petition, as well as
that presented in opposition thereto, and has determined that said
petition should be granted except as to the premises of Elmer
Young, Effie Weldon and Laurence Osborn, constituting the northerly
portion of the area sought to be rezoned, and that the remaining
territory described in the said petition should be rezoned from
CI District to R3 District, and that the Zoning Ordinance of the
City of Gilroy should be amended accordingly.
NOW, THEREFORE, THE COUNCil OF THE CITY OF GilROY DOES
ORDAIN AS FOllOWS:
SECTION I
That all that portion of Block I South of Range 2 West of
the City of Gilroy lying easterly of the alley extending through
said block in a general northerly and southerly direction, with
the exceptions above noted, be rezoned from a CI District and
placed in and become a part of R3 Zone or District.
SECTION 2
Reference is hereby made to the zoning map of the City of
Gilroy and said map shall be forthwith changed to reflect the
re-classification of the afore-described area.
SECT! ON 3
All ordinances and parts of ordinances in conflict herewith
are hereby repeaTed.
SECT! ON 4
This ordinance shall take effect and be in full force thirty

(30) days from and after its adoption and approval.
