ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY / D;z;-&

OF THE GILROY CITY CODE BY TAKING PROPERTY BELONGING TO t &-"C-:;, ~~,
JOSEPH MC CORMACK FROM R-I DISTRICT AND PLACING SAME IN
CO DISTRICT, COMBINED WITH "S" AREA
WHEREAS, application has been made to the Planning Commission of the
City of Gilroy to amend the Zoning Ordinance of said City by taking from
Rl District and placing in CO (Commercial) District as the same are
defined in the Zoning Ordinance of the City of Gilroy the following
described premises located in said City:
BEING a portion of Las Animas Ranch Lot No. 16 as shown
on Map No. 7 accompanying the report of the Referees in
the Las Animas Rancho Partition Suit, Action No. 5536 had
in the Superior Court of the State of California, in and
for the County of Santa Clara, and being more particularly
a portion of lands of Fenton OJConnell as described in the
deed from Samuel Hamburger, Inc., recorded April 10, 1958
in Volume 4048 of Official Records at page 583, Santa Clara
County Records and described as follows:
"BEGINNING at the intersection of the centerlines of
Sixth Street and Miller Avenue as shown on Map entitled
"Eschenbur.g Park, Unit No.4, Tract No. 2956" and recorded
June 22, 1961, in Book 134 of Maps at Page 30, Santa Clara
County Records, and running thence along the centerline of
Miller Avenue as described in said deed to Fenton OIConnell,
S. 00 52J West 320.00 feet; thence at right angles to said
centerline, N. 890 081 W. 204.19 feet; thence parallell with
Miller Avenue, N. 00 52J E. 320.00 feet; thence S. 890 08J E.
204.19 feet to the point of beginning, and
CONTAINING THEREIN 1.50 acres of land, gross, and 1.206
acres of land, net, exclusive of the easterly 40.00 feet
within Miller Avenue deeded to the County of Santa Clara,
December 14, 1926, and recorded December 29, 1926 in Book
290 of Official Records, Page 276, Santa Clara County Records.";
and
WHEREAS, the said Planning Commission, after holding the hear-
ings in accordance with the requirements of the said Zoning Ordinance
and the laws of the State of California has made its report to the Council
of the City of Gilroy in which it recommends that the said Zoning Ordinance
be amended in accordance with said application but has added the requirement
in its recommendation that the said premises be subject to the regulations
of an "S" Area as the same is defined in said Zoning Ordinance; and

WHEREAS, the Council of the City of Gilroy has heretofore fixed
the 21st day of December, 1964, at the hour of 8 olclock, p.m., in the
Council Chambers in the City Hall at No. 10 South Rosanna Street, Gilroy,
California, as the time and place for the said hearing of the said report
and notice of said hearing has been given in accordance with the Zoning
Ordinance of the City of Gilroy and laws of the State of California, and
the hearing has now been held at said time and place and objections having
been made to the said rezoning and the Council having duly considered the
said application therefor and the said objections thereto and the report
and the recommendation of the Planning Commission, and having determined
that said Zoning Ordinance should be amended in accordance with the said
appl i cat ion,
NOW THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES HEREBY ORDAIN
AS FO LLOWS:
SECTION 1
That the Zoning Ordinance of the City of Gilroy be and the same
is hereby amended by taking from Rl District and placing in CO District
the said premises hereinbefore described, said premises to be subject to
the regulations of "S" Area as the same is defined in the said Zoning
Ordinance of the City of Gilroy.
SECT! ON 2
The zoning map of the City of Gilroy shall be changed to reflect the
effect of the amendment to said ordinance.
SECT! ON 3
All ordinances and parts of ordinances in conflict herewith are here-
by repealed.
SECT! ON 4
This ordinance shall take effect and be in full force thirty (30) days
from and after its passage and approval
