ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY
OF GILROY BY REMOVING FROM R3 DISTRICT AND PLACING
IN C2 DISTRICT PREMISES OF JOSEPH J. MASINI AND
DOMENIC P. MASINI LOCATED ALONG THE SOUTHERLY LINE
OF TENTH STREET
WHEREAS, JOSEPH J. MASINI and DOMENJ:C P. MASINI having heretofore
filed with the Planning Commission of the City of Gilroy a petition
for the rezoning from R3 District and placing in a C2 District
the following described premises located along the southerly line
of Tenth Street in said City, to wit:
COMMENCING at the point on the Southerly line of Tenth
Street, distant thereon 60 feet Easterly from the point
of intersection of the Southerly line of Tenth Street
with the Easterly line of that certain one acre tract of
land conveyed in two parcels by Miller & LuX, Inc., to
Alfredo Maracini by deed dated July 17, 1922, and
recorded in the Office of the County Recorder of the
County of Santa Clara, state of California, in Volume 556
of Official Records, at page 552; running thence south
190 591 30" East 311.14 feet; thence in an Easterly
direction parallel with the Southerly line of Tenth
street 75 feet; thence North 190 59' 30" i.'Jest, 311.14
feet to the southerly line of Tenth street, and thence
along the Southerly line of Tenth Street in a westerly
direction to the point of beginning, and being a strip
of land 75 feet wide adjacent to and immediately East of
the land described in the deed from John Ciabatarri to
Assunto Masini, dated the 21st day of october, 1947, and
of record in the Office of the County Recorder, County
of Santa Clara, state of California, in Book 1520 of
Official Records at page 453. ;
and
WHEREAS, the Planning Commission has held a public hearing
upon the said application, in accordance with the law and the
said Planning Commission having filed its report upon the said
application with the Council of the City of Gilroy in which it
recommends that the said application be granted; and
WHEREAS, the Council of the said City has heretofore fixed
the 20th day of April, 1965, at the hour of 8:00 0'c10ck, p.m.,
in the Council Chambers in the City Hall at NO. 10 south Rosanna
Street, G~lroy, California, as the time and place for hearing the
said report and reco~rnendatj_on uI:on thE: said application and

notice of the said hearing has been given in accordance with the
said zoning ordinance, and a public hearing has now been held upon
the said application, at the time and place fixed in the said notice,
before the Council, and the council having duly considered the
said application and the evidence presented, has determined that
the said amendment to the said zoning ordinance should be granted
in accordance with the application.
NOW THEREFORE, the Council of the city of Gilroy does ordain
as follows:
Section 1. The Zoning Ordinance of the city of Gilroy is
hereby amended by removing from R3 District and placing in C2
District, as the same are defined in the said zoning Ordinance, the
premises hereinbefore described.
Section 2. The official map constituting a part of the zoning
Ordinance of the city of Gilroy shall be amended to reflect the
foregoing change of G1assification of the said property.
Section 3. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
section 4. This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval.
