ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY REZONING FROM Rl DISTRICT
TO R3 DISTRICT~ UPON CONDITIONS, TERRITORY CONSTITU-
TING A PORTION OF THE PREMISES WITHIN THE ANNEXATION
KNOWN AS "SOUTHWEST ANNEXATION 65-2 TO THE CITY OF
GILROyt.
WHEREAS, the application has heretofore been made by ORBIT
DEVELOPMENT CO.t Inc., a California corporation, to the Planning
Commission of the City of Gilroy for the rezoning from Rl District
and placing in R3 District the following described premises, to wit:
BEING a portion of Las Animas Ranch Lot 16 as shown on Map
No. 7 accompanying the Final Report of the Referees in the
Las Animas Rancho Partition Suit, Action No. 5536 had in the
Superior Court of the State of California, in and for the
County of Santa Clara, and being more particularly described
as follows:
IIBEGINNING at a point in the southwesterly line of that
certain 41. 72:2 acre parcel of land described in the Deed
from C.N.Smith to Frank Filice, et ux, dated February 15,
1952, and recorded February 15, 1952, in Volume 2366 at
page 302, Official Records of Santa Clara County; distant
thereon S.20000'E.92.00 feet from a granite monument at
the original southwesterly corner of the City of Gilroy,
and running thence parallel with the original southeasterly
line of the City of Gilroy N.70oE.1133.00 feet; thence
S.200plI30"E.210.00 feet; thence N.70oE.238.07 feet, more
or less, to a point in the southwesterly line of Rosanna
Annexation No.1 to the City of Gilroy as described in
Resolution No. 920 of said City adopted May 3, 1965;
thence along the southwesterly line of said Annexation
S.20001t30IlE.1021.93 feet to the southwesterly corner
thereof; thence along the southerly line thereof S.890

feet to the point of beginning, and CONTAINING THEREIN

WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of the public hearing upon the said application,
in accordance with the law, has held the hearing, and has made
its report to the Council of the City of Gilroy, in which it
recommends that both of the above described premises be rezoned
R3 District and that said rezoning be subject to the following
conditions:
(l) That the entire area rezoned shall be subject to
"s" Zone regulations.
(2) That said zoning is dependent upon the development
of the area in accordance with plans heretofore submitted
to the Planning Commission.
(3) That said rezoning shall be subject to approval of a
tentative subdivision map covering the area.
(4) That lots fronting on Tenth street and all other
areas comprising the annexation known as "SOUTHWEST ANNEXA-
TION 65-2 TO THE CITY OF GILROylI be subject to Rl B 7 S
zoning.

WHEREAS, the Council of the City of Gilroy has fixed the 21st
day of February, 1966, at the hour of 8:00 onclock, p.m., in the
Council Chambers in the City Hall at No. 10 South Rosanna Street,
Gilroy, California, as the time and place for hearing the said
report and recommendation upon the said application and notice of
the said hearing has been given in accordance with the said zoning
ordinance, and a public hearing has now been held upon the said
application, at the time and place fixed in the said notice,
before the Council, and the Council having duly considered the
said application and the evidence presented, and has determined
that the said Zoning ordinance should be amended in accordance
with the report of the said Planning Commission,
NOW THEREFORE~ THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy is
hereby amended by removing from Rl District and placing in R3
District, as the same is described and defined in the zoning
ordinance of the City of GilroYl all the premises hereinbefore
described in the preamble of this ordinance, said rezoning to be

subject to the conditions hereinbefore set forth, as contained
in the report of the said Planning Commission
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to reflect
the foregoing change of classification of the said prop€rty.
Section 3: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval.
