Ordinance 781 ORDINANCE NO. 781 AN ORDINANCE OF THE CITY OF GILROY CHANGING THE TITLE AND DESIGNATION OF THE HEAD OF THE DEPARTMENT OF PUBLIC WORKS FROM "DIRECTOR OF PUBLIC WORKS" TO "DIRECTOR OF PUBLIC WORKS-CITY ENGINEER" AND AMEND- ING SECTIONS 2.1, 2.43, 2.44, 2.45, 2.58, and 2.59 OF THE GILROY CITY CODE; SAID AMENDMENTS MADE NECES- SARY BY THE CHANGE IN SAID TITLE AND DESIGNATION THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1. Sec. 2.1 of the Gilroy City Code is hereby amended by changing the description of the title of the head of the Department of Public Works to read as follows: "Director of Public Works-City Engineer" Section 2. Sec. 2.43 of the Gilroy City Code is hereby amended to read as follows: Sec. 2.43. Director of public works-city engineer--Appointment. 'rhe director of public works-city engineer shall be the head of the Department of Public Works and shall be appointed by the city administrator, with the consent of the council. Section 3. The said Gilroy City Code is hereby amended in the following particulars: Wherever in the Gilroy City Code the term or designation "director of public works" occurs, the said term or designation is hereby amended so as to read and mean "director of public works-city engineer;" and Wherever in the said Gilroy City code the head of the Department of Public Works is referred to, it shall mean the "director of public works-city engineer;" and Wherever in the said Gilroy City Code the "director of public works"is charged with the performance of a duty, the said duty shall be performed from and after the effective date of this ordinance by the "director of public works-city engineer." Section 4. subdivision (4) of Sec. 2.44 is hereby amended to read as follows: ( 1) Sec. 2.44. Same--powers and duties. (4) Engineering work. Perform or direct all phases of engineering work required in connection with the functions of the city. Section 5. subdivision (~) of Sec. 2.45 is hereby amended to read as follows: Sec. 2.45. Divisions. (e) Division of engineering. The division of engineering shall be under the direct supervision of the director of public works-city engineer and shall be responsible for and required to: (1) Public Improvements. Supervise and perform the prepara- tion of all required plans and specifications relating to any and all public improvements, including the designing, drafting and estimating; (2) Staking, Mapping and Inspection. Provide the staking, mapping and inspecting of work in progress in the field and perform other related work as required; (3) Changes on Public Works projects. Engineer and process forcpproval any essential changes on public works projects found to be necessary while work is in progress; (4) Filing of Documents. Prepare and file all necessary permanent official maps, records, reports, documents, and data in connection with the completed work as performed. (5) prepare Documents. Prepare all the necessary forms, notices and contract documents for public works and other projects to be let by bid and make necessary reports for payment; (6) Lands, Easements and Rights-of-Way. Supervise and perform the acquisition of all lands, easements and rights of way required by the city and maintain suitable maps and records showing these holdings; (7) Subdivision Maps and Agreements. certify approved subdivision maps; prepare and process subdivision improvement agreements; and supervise, coordinate and inspect the required installation. (8) Contract Services. Until such time as the growth and expansion of the city services demands an increase in staff and personnel in this division, any of the above listed services may be performed under contract with a public or private firm or agency. Such contract to be signed by the city administra- tor with the advise of the director of public works-city engineer and the consent of the council. Section 6. Sec. 2.58 of the Gilroy city Code is hereby amended to read as follows: Sec. 2.58. Director of Parks and recreation--Appointment. The department of parks and recreation shall be under the direct supervision of the director of parks and recreation, who shall be appointed by the city administrator with the consent of the council. (2) Section 7. Sec. 2.59 of the Gilroy city Code is hereby amended to read as follows: Sec. 2.59. Same--powers and duties. The department of parks and recreation shall be divided into two divisions with the following duties and responsibilities: (a) Division of Parks. The division of parks shall be under the supervision of a parks foreman who shall be appointed by the city administrator. The parks foreman shall have the following responsibilities and duties: (1) Operate Parks. To operate the various parks of the city and maintain the same in an orderly and safe condition; (2) Maintain Lawns and Shrubs. To maintain and cultivate the lawns, shrubs and esthetic installations around the city, and other public buildings as assigned. (b) Division of Recreation. The division of recreation shall be under the supervision of a recreation supervisor, who shall have the following duties and responsibilities: (1) Recreation program. To administer a broad program of public recreation for all age groups, designed to encourage and maintain interest and participation by individuals and by organizations, both public and private; utilizing the avail- able school facilities during the summer vacation season; (2) Swimming Pool. Operate and maintain the swimming pool facilities; (3) R2creational Activities. Administer and supervise the various recreational activities sponsored by the city under contract or agreement with other agencies. Section 8. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 9. If any word, phrase, sentenence, or part of this ordinance shall be declared to be invalid by any court of competent jurisdiction, the council does hereby declare that it would have passed all the remaining portion of said ordinance if the invalid part were omitted, and the invalidity of one part of this ordinance shall not be held to invalidate the remaining portion of said ordinance. Section 10. This ordinance shall go into effect and be in full force thirty (30) days from and after its adoption and approval. section 11. This ordinance was introduced before and ordered published by title and summary by the council at a regular meeting thereof held on the 19th day of December, 1966, and finally passed (3) and adopted by the council at a regular meeting thereof held on the 3rd day of Jan.
