Ordinance 782 ORD INANCE NO. 782 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY PROVIDING THAT MEMBERS OF SAID COUNCIL SHALL BE PAID SALARIES OR COMPENSATION AND FIXING THE AMOUNT AND TIME FROM AND AFTER WHICH SAID SALARIES SHALL BE PAID AND ORDERING THE PAYMENT THEREOF. WHEREAS, No provision has ever been made heretofore for the payment of any salary or other compensation to members of the City Councilor its predecessor, Common Council, of the City of Gilroy, for serving the City in their official capacity, but said Council Members have been willing to serve during the long period when the community was in the Village or 6th City Classificationi and WHEREAS, In the last decade or so, the City has experienced a pronounced and now accelerating growth until now its population within its corporate limits numbers about 10,000 inhabitants, and there is every reason to believe that this growth will continue; and WHEREAS, Said growth of this City and the greatly expanded activities of the federal government into matters of local concern requiring negotiations, consultations, and dealings with numerous governmental agencies in order to obtain grants of money for various purposes and facilities forming a part of the "Great Society" program, has enormously increased the work required to be done in conducting the city's business, by all the departments of the municipality, and, with the many annexations of territory and the attendant subdivisions, zoning changes, water and sewer problems, fire department expansion, new street development and planning for the future, shopping districts, traffic congestion, establishment of public parks, and recreation facilities, financing of large improvements, and many other important problems, the proper solution and handling of which is imperative if interference with , <,; with the continued growth of the City is to be prevented, the labors, diligence, thought, time and worry of members of the legislative branch of the city government have likewise increased to such an extent as to make the work of the Council not only quite burdensome at times, but also to act as an influence against citizens serving on the Council, especially since the questions which frequently confront the Council are of a controversial nature and enemy-making no matter how decided; and WHEREAS, The publie seems to understand the foregoing and if the Council is correctly advised, believes that some compensation should be paid to councilmembers for the greatly increased services and duties which they must of necessity perform for the benefit of the entire community and the payment of compensation even though it may be small, will increase the importance of the office of Councilmember, and serve to attract candidates for the positions no matter how efficiently councilmen perform their duties under present "no pay" regulations; and WHEREAS, Other cities similarly situated as Gilroy have found it aavisable and in the public interest to pay compensation to their councilmembers and the experiment ought to be tried out in GilroYi NOW THEREFORE, Be it resolved and it is hereby ordained by the City Council as follows: SECTION 1. Members of the City Council of the City of Gilroy shall be paid a compensation or salary for their services rendered as Councilmembers, herein fixed as follows: (a) Each councilman elected as such at the next general municipal election held in the City of Gilroy following the adoption,fof this Ordinance, shall, from the beginning of his termfOffice, be paid and receive during the time he holds the office a regular salary mr compensation as councilman of $25.00 for each regular meeting of the Council he attends, and the Mayor of the City of Gilroy elected at the next general municipal election held in said City following the adoption of this Ordinance and subsequent Mayors of said city, shall receive and be paid a s:iary or compensation of $ 150.00 per month for each month, he serves as Mayor from and after the beginning of his term. -2- II 'I (b) Present councilmen, whose term of office will not expire until the year 1969 or those elected or appointed 1 to fill unexpired terms thereof shall receive and be paid the same salary and compensation and from the same time as 2 those eligible for a salary by virtue of the beginning of a new term of office on a council having council members 3 serving staggered terms as provided by Section 36514 of the Government Code. 4 SECTION 2. The population of the City of Gilroy at the time 5 of the adoption of this ordinance for the purposes of this Ordinance has been determined by the Departmentof Finance of 6 the City of Gilroy to be over lD.OOO and the salaries herein fix d are based upon that determination. 7 SECTION 3. This Ordinance shall take effect and be in 8 full force thirty (30) days from and after its adoption and approval. 9 SECTION 4. If any portion of this Ordinance shall be held 10 invalid by any Court having jurisdiction to make such determination the council declares it would have adopted II the remaining portion of the ordinance and said invalidity of one part shall not affect the validity of the remaining 12 part. 13 14 The foregoing Ordinance was introduced and ordered 15 published by title and summary at a regular meeting of the 16 Council held on the 19th day of December, 1966, and was finally 17 adopted at a regular meeting of said Council held on the 3rd 18 day of January, 1967, by the following vote: 19 NOES: COUNCI LMEMBERS : All emand, Duff in, Eckard ,Goodri ch, Quartirol i ,Wentworth, and Petersen.
