ORDINANCE NO. 789
ORDINANCE OF THE CITY OF GILROY AMENDING SEC. 4 OF ORD~NANCE
NO. 711 GENERALLY KNOWN AS THE ZONING ORDINANCE OF THE CITY
OF GILROY ESTABLISHING A NEW ZONING DISTRICT DESIGNATED AS
III-Z11 INTERIM ZONE DISTRICT AND BY AMENDING SEC. 60.2 OF
SAID ORDINANCE REGULATING THE USE OF NEWLY ANNEXED AREAS TO
THE CITY OF GILROY AND SETTING FORTH REGULATIONS FOR SAID
NEW ZONING DISTRICT.
WHEREAS, The Planning Commission of the City of Gilroy did on the
5th day of January, 1967, adopt Resolution No. 353 declaring its intention
to institute proceedings for the purpose of amending Sec. 4 of Ordinance No.
711 (Zoning Ordinance) of the City of Gilroy, by establishing a new zoning
district to be designated as III-Z (Interim Zone) Districtl' and by amending
Sec. 60.2 of said Ordinance regulating the use of newly annexed areas to
the City of Gilroy, and did in said Resolution institute such proceedings
by proposing therein that the said Zoning Ordinance be so amended, the pro-
posed amendments being hereinafter set forth, and
WHEREAS, said Planning Commission did fix the date for the hearing
of said proposed amendments, cause notice of said hearing to be given in
accordance with law, held the public hearing at the time and place thus fixed,
and duly made its report after the said hearing to the Council, in which the
Commission recommends that the said amendments be adopted; and
WHEREAS, The report of the said Planning Commission has been hereto-
fore presented to the Council, which fixed the 20th day of February, 1967, at
the hour of 8:00 p.m., in the Council Chambers of the City Hall, No. 10 South
Rosanna Street, Gilroy, California, as the time and place for the hearing of
said proposal, report and recommendation, and notice of said hearing has been
given in accordance with the Zoning Ordinance of satd City and in accordance
with the law, and said hearing was regularly continued to February 21, 1967
and said hearing has now been held before the Council at the time to which it

was continued and the Council, after hearing the facts presented, has deter-
mined that said proposed amendments should be adopted,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
Section 1: Section 4 of Ordinance No. 711 (Zoning Ordinance)
of the City of Gilroy is hereby amended by adding thereto a
new zoning district to read as follows:
III-Z or Interim Zone District".
Section 2. Section 60.2 of said Zoning Ordinance is hereby
amended to read as follows:
IISEC. 60.2 ZONING OF ANNEXED AREAS. Any areas annexed to
the City after the effective date of this Ordinance shall
immediately upon such annexation be automatically classi-
fied as an I-Z District until the zoning plan for such
areas has been adopted by the City Council upon recommenda-
tion of the Planning Commission.
(a) Purpose. The purpose of this interim zone district is
to provide for temporary uses of recently annexed property
without permitting the erection of structures during the
period that the appropriate permanent zoning is being studied
by the Planning Commission and the City Council. Owner may
request zoning concurrent with annexation providing such a
request does not conflict with the City's General Plan.
(b) Pr i nc i pa 1 Uses permi tted:
(1) Crop and tree farming
(2) Parking
(3) Existing businesses may be included in non-
conforming uses..
(c) Building Regulations. No structure shall be erected upon
any property having an Interim Zone (I-Z) classification.
Section 3. The zoning map forming a part of the Zoning Ordin-
ance of the City of Gilroy is hereby amended to reflect the
foregoing amendment.
Section 4. This Ordinance shall take effect and be in full
force thirty (30) days from and after its adoption and approval.
The foregoing Ordinance was introduced and ordered publ ished by
title and summary at a regular adjourned meeting of the Council of the City
of Gilroy held on the 21st day of February, 1967, and was regularly adopted

by the Council at a regular meeting thereof held on the 6th day of March,
]967, by the following vote:
