Ordinance 790 ORDINANCE NO. 790 ORDINANCE OF THE CITY OF GILROY AMENDING SECTION 82 OF THE ZONING ORDINANCE OF THE CITY OF GILROY BY CHANGING THE TIME WITHIN WHICH AN APPEAL MAY BE TAKEN FROM ANY DECISION OF THE PLANNING COMMISSION FROM TEN DAYS TO FIFTEEN DAYSe WHEREAS, The Planning Commission of the City of Gilroy has hereto- fore initiated on its own motion proceedings for the amendment of Section 82 of the Zoning Ordinance of said City so that the same shall read as herein- after set forth; and WHEREAS, The said Planning Commission has held a hearing upon the said proposal after due and regular notice of said hearing was given, and the report of said Planning Commission upon the said proposal has been filed with t he City Council, in which it recommends the adoption of such amendment, and the said Council has heretofore fixed the 20th day of February, 1967, at the hour of 8:00 p.m. in the Council Chambers of the City Hall, NOe 10 South Rosanna Street, Gilroy, california, as the time and place for the hearing of said report, and notice of said hearing has been given as required by law, and the said hearing was regularly continued to February 21, 1967, and the continued hearing has been held in accordance with the said notice; and con- tinuance and WHEREAS, the Council has heard and considered all of the evidence presented at said hearing and has determined that the said proposed amend- ment should be adopted, NOW THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLO'vJS: Section Ie Section 82 of the Zoning Ordinance of the City of Gilroy is hereby amended to read as follows: "Sece 82 APPEAL" Any person aggrieved by any decision of the Planning Commission made under the provisions of this chapter may, within fifteen (15) days from the date of such decision appeal to the City Council by written notice of appeal filed in duplicate and - I - 79(') shall set forth specifically wherein the Commissions1 findings and decisions were in error. Upon hearing the appeal, the City Council shall consider the record and such additional evidence as may be offered and may affirm, modify, or reverse, in whole or in part, the order, requirement, decision, determination, inter- pretation or ruling appealed from, or make and substi- tute such other and additional decision or determina- tion as it may find warranted under the provisions of this chaptero The standards herein established to govern the discretion of the Commission shall apply with equal force to the actions of the Councilo" Section 20 This Ordinance shall take effect and be in full foce thirty (30) days from and after its passage and approval.. The foregoing ordinance was introduced and ordered published by title and summary at a regular adjourned meeting of the Council of the City of Gilroy held on the 21st day of February, 1967, and finally adopted at a regular meeting of said Council held on the 6th day of March, 1967, by the following vote: AYES: NOES: COUNCIL MEMBERS: Allemand,Duffin,Goodrich,Quartiroli, Wentworth, and Petersen.
