Ordinance 811 ORDINANCE NO. 811 AN ORDINANCE OF THE CITY OF GILROY AMENDING ARTICLE XI OF CHAPTER 2 OF THE GILROY CITY CODE BY ADDING THERETO A NEW SECTION DESIGNA- TED AS SEC. 2.59-2 REGU~TING THE OPERATION OF MOTORCYCLES IN ANY PUBLIC PARK IN THE CITY AND FORBIDDING THE DRIVING OR OPERATION OF MOTORCYCLES IN ANY PUBLIC PARK IN SAID CITY AND MAKING THE VIOIATION OF THE ORDINANCE A MISDEMEANOR. THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECT ION I: Article XI of Chapter 2 of the Gilroy City Code is hereby amended by adding thereto a new section hereby designated as Sec. 2.59-2 to read as follows: Sec. 2.59-2 REGUIATION OF OPERATION OF MOTOR VEHICLES IN PUBLIC PARKS. (a) It shall be unlawful for anyone to drive or operate an automobile or truck in any pub- lic park in the City of Gilroy except upon an established road in said parks or upon an established parking area in said park designa- ted as such by a notice posted, or sign erected, thereon. (b) It shall be unlawful for anyone to drive or operate a motorcycle in any public park in the City of Gilroy. (c) A violation of any prov~s~on of this sec- tion shall constitute a misdemeanor and be pun- ishable as such. SECTION II: If any provision, portion, phrase, clause or word of this Ordinance shall be held to be unlawful or unconstitutional in any Court of Competent Jurisdiction, the remaining portion shall not be affected thereby. The Council declares it would have passed and adopted the remaining portion of the Ordinance notwithstanding the unlawful portion. SECTION III: All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. - 1 - 81/ SECTION IV: This Ordinance is hereby adopted as an emergency measure and shall take effect and be in full force from and after its adoption and approval. The reasons for the existence of said emergency are as follows: Youths and others in considerable numbers have been intention- ally and indiscriminately driving and operating motor vehicles in- cluding motorcycles, in Christmas Hill park, the only real public park in the City of Gilroy at the time of adopting this Ordinance, upon areas thereof devoted to lawns and upon other portions all of which are being seriously and extensively damaged, and rendered un- sightly thereby, and costly to restore and such acts will continue unless made unlawful and more authority and remedies are available than those now possessed by the City to combat and prevent such acts of vandalism and carelessness.
