ORDINANCE NO. 817
AN ORDINANCE OF THE CITY OF GILROY
RELATING TO OPERATION OF THE GILROY
CITY DUMP AND PROVIDING FOR CHARGES
FOR THE USE THEREOF BY RESIDENTS AND
NON-RESIDENTS OF THE CITY
WHEREAS, the City of Gilroy maintains a rubbish disposal
area known as the Gilroy City Dump for the primary benefit of
residents of the city, and
WHE~AS the city wishes to contract for the operation of
said city dump by a private party and for the compensation of
said operator, and
WHEREAS, the city wishes to establish the rates to be
charged resident and non-resident users by said operator.
THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I: The city may contract on such terms as it deems
advisable for the private operation and maintenance of the rubbish
disposal area owned by the city and known as the Gilroy City
Dump. The contract shall not be assignable by the operator without
the prior written consent of the city council.
SECTION II: The city dump shall be maintained primarily
for the benefit of residents of the city and, eKcept for a garbage
collector licensed by the city, shall be used only for the
disposal of rubbisho
SECTION III: The operator shall charge users of the city
dump the following rates:
Residents of the city, provided they establish to the
operator-s satisfaction the fact of their residence within the
City of Gilroy by current driver's license or similar identification:

SECTION IV: The operator shall maintain accurate records
of all resident and non-resident users of the dump and of the
fees collected and shall make a full accounting thereof to the
city each calendar month. The operator shall retain the resident
fees and one-half (~) of the non-resident fees so collected as
his compensation for operating and maintaining the dump and shall
remit to the city with each accounting the remaining one-half (~)
of the non-resident fees as compensation for the use of city
property.
SECTION V: All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION VI: This ordinance shall take effect and be in
force thirty (30) days from and after its passage and approval.
