'^\ ORDINANCE NO. 820 ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REZONING PREMISES BETWEEN ALEXANDER STREET AND SOUTHERN PACIFIC RAILROAD AND BETWEEN PROPOSED TENTH STREET AND THE WESTERLY PROLONGATION OF BANES LANE, FROM Rl DISTRICT TO M2 DISTRICT WHEREAS, the application has heretofore been made by MANABI HlRASAKI to the Planning Commission of the City of Gilroy for the rezoning from Rl District and placing in M2 District the premises hereinafter described; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, and has made its report to the Council of the City of Gilroy, in which it recommends that the hereinafter described premises be rezoned from Rl (Single Family Residential) District to M2 (Light Industrial) District; and WHEREAS, the Council of the City of Gilroy has fixed the 3rd day of June, 1968, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall at No. 10 South Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice, before the Council, and the Council having duly considered the said application and the evidence presented, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission, NOW THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by removing from Rl District and placing in M2 District, as the same is described and defined in the Zoning 820 -1- 1- Ordinance of the City of Gilroy the following described premises: All that certain real property situate in the County of Santa Clara, State of California, described as follows: BEGINNING at a point in the Northeasterly line of that certain 8.326 acre tract of land described in the Deed from Hirasaki Farms, a corp. to Manabi Hirasaki et ux, dated June 8, 1949, recorded June 10, 1949 in Book 1801 Official Records, page 137, Santa Clara County Records at the Eastern- most corner of that certain 1 acre tract of land described in the Deed from Manabi Hirasaki et ux, to Mike J. Filice et aI, dated October 3, 1951, recorded November 6, 1951 in Book 2311 Official Records, page 531, Santa Clara County Records; thence from said point of beginning South 700 00' West along the Southeasterly line of said 1 acre tract for a distance of 438.92 feet to the Southernmost corner thereof in a Southwesterly line of said 8.326 acre tract; thence South 200 00' East along a Southwesterly line of said 8.326 acre tract 444.97 feet; thence continuing along a South- westerly line of said 8.326 acre tract along an arc of a curve to the right with a radius of 17,138.8 feet through a central angle of 00 30' 55" for an arc distance of 154.14 feet to an iron pipe set at the Southwesterly corner thereof in the Northerly line of Bane Lane, also being the Southerly line of Ranch Lot No. 44, hereinafter referred to; thence South 890 45' East along said Northerly line of Bane Lane for a distance of 324.44 feet to the Southwesterly corner of that certain 0.199 acre tract of land described in the Deed from Manabi Hirasaki, et ux, to Gilroy Nisei Athletic Club, a non-profit corporation, dated December 24, 1951, recorded April 19, 1956 in Book 3472 Official Records, page 17, Santa Clara County Records; thence North 200 00' West along the Southwesterly line of said 0.199 acre tract for a distance of 75.00 feet to the Westernmost corner thereof; thence North 700 00' East along the Northwesterly line of said 0.199 acre tract for a distance of 93.82 feet to the Northernmost corner thereof; thence South 20? 00' East along the Northeasterly line of said 0.199 acre tract for a distance of 109.61 feet to the Easternmost corner thereof in the said Northerly line of Bane Lane; thence South 890 45' East along said last mentioned line 42.63 feet to the Easternmost corner of said 8.326 acre tract above referred to; thence North 200 00' West along the Northeasterly line of said 8.326 acre tract for a distance of 760.68 feet to the point of beginning, and being a portion of Ranch Lot 44 as shown on Map No. 7 accompanying the final report of the Referees in the Las Animas Rancho Partition Suit, Action No. 5536 had in the Superior Court of the State of California, in and for the County of Santa Clara. EXCEPTING THEREFROM all that portion thereof described in the Deed from Manabi Hirasaki et ux to the City of Gilroy, a Municipal Corporation, dated September 17, 1957 and recorded December 8, 1964 in Book 6770 Official Records, page 524, Recorder's Serial Number 2756376 more particularly described as follows: COMMENCING at an iron pipe in the Southeasterly line of Ninth Street in the City of Gilroy, distant thereon South 700 00' West 56.75 feet from the point of intersection of the Southeasterly line of Ninth Street with the Southeasterly -2- prolongation of the Northeasterly line of Alexander Street; thence leaving Ninth Street South 210 52' East 594.31 feet to an iron pipe on the Southerly City Limit Line of said City of Gilroy; thence South 200 00' East 26.17 feet to the true point of beginning of this description, said true point of beginning also being the most Easterly corner of that certain 1.00 acre parcel of land conveyed by Manabi Hirasaki, et ux, to Mike J. Filice, et aI, by Deed dated October 3, 1951 and recorded November 6, 1951 in Book 2311 of Official Records, page 531, Santa Clara County Records; thence from said true point of beginning along the South- easterly line of said 1.00 acre parcel of land, South 700 00' West 40.00 feet; thence South 210 31' 15" East 753.57 feet to the Northerly line of Banes Lane; thence along the Northerly line of Banes Lane 21.32 feet to the most Easterly corner of said 8.326 acre tract of land; thence leaving Banes Lane and running along the Northeasterly line of said 8.326 acre tract of land North 20Q West 760.68 feet to the true point of beginning, and CONTAINING THEREIN 0.349 acres more or less. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the foregoing change of classification of the said property. Section 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
