ORDINANCE NO. 850
ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY REZONING 10.71 ACRES FROM
I-Z TO R-1, and 2.62 ACRES FROM I-Z to R-3 FOR PRO-
PERTY LOCATED AT THE NORTHWEST CORNER OF MOREY
AVENUE AND HECKER PASS HIGHWAY
WHEREAS, the application has heretofore been made by
GEORGE T. DUFFIN to the Planning Commission of the City of
Gilroy for the rezoning of 10.71 acres from I-Z (Interim Zone)
District to R-1 (Single Family Residence) District and the
rezoning of 2.622 acres from I-Z (Interim Zone) District to R-3
(Low Density Multiple Family Residence) District for property
hereinafter described; and
WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of a public hearing upon the said application,
in accordance with the Zoning Ordinance of the City of Gilroy,
has held the hearing, and has made its report to the Council of
the City of Gilroy, in which it recommends that 10.71 acres of the
hereinafter described premises be rezoned from I-Z (Interim Zone)
District to R-1 (Single Family Residence) District, and 2.622 acres
be rezoned from I-Z (Interim Zone) District to R-3 (Low Density
Multiple Family Residence) District; and
WHEREAS, the Council of the City of Gilroy has fixed the
3rd day of March, 1969, at the hour of 8:00 o'clock P.M. in the
Council Chambers in the City Hall at No. 10 South Rosanna Street,
Gilroy, California, as the time and place for hearing the said
report and recommendation upon the said application, and notice
of the said hearing has been given in accordance with the said
Zoning Ordinance, and a public hearing has now been held upon the
said application, at the time and place fixed in the said notice,
before the Council, and the Council having duly considered the
said application and the evidence presented, and has determined
that the said Zoning Ordinance should be amended in accordance with
the report of the said Planning Commission,
NOW THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS~

Section 1: The Zoning Ordinance of the City of Gilroy is
hereby amended by removing from I-Z District and placing in R-3
District, as the same is described and defined in the Zoning
Ordinance of the City of Gilroy, the following described premises:
BEING a portion of Subdivision L of Lot 3 as shown upon that
certain Map entitled "Map accompanying the Report of the
Referees in Partition of the Lands of the Estate of L. Fine,
Deceased", which map is filed for Record in Book "F" of Maps
at page 9, Records of Santa Clara County, California, and
being more particularly described as follows:
BEGINNING at the intersection of the northerly line
Subdivision L with the Westerly line of Morey Avenue,
and running thence along the northerly line of
Subdivision L N.89054'W. 303.34 feet; thence leaving
said Northerly line S. 4056'W. 270.96 feet; thence
S.89054'E. 104.72 feet; thence S.4056'W. 193.68 feet;
thence N.73034'30"E. 212.51 feet, more or less, to
the westerly line of Morey Avenue; thence northerly
along said westerly line 403.90 feet, more or less
to the point of beginning.ilR
CONTAINING THEREIN 2.622 acres.
Section 2: The Zoning Ordinance of the City of Gilroy is
hereby amended by removing from I-Z District and placing in R-1
District, as the same is described and defined in the Zoning
Ordinance of the City of Gilroy, the following described premises:
BEING a portion of Subdivision L of Lot 3 as shown upon that
certain Map entitled "Map accompanying the Report of the
Referees in the Partition of the Lands of the Estate of
L. Fine, Deceased", which map is fi led fur Record in Book "F"
of Maps at page 9, Records of Santa Clara County, California,
and being more particularly described as follows:
BEGINNING at the intersection of the westerly
line of Morey Avenue with the northerly line of
said Subdivision L and running thence along said
northerly line N.89054'W. 90105 feet to the
northerly common corner to Subdivisions K and L;
thence along said common line S.OoOO'30"W.
640.60 feet to the northwesterly corner of that
certain parcel of land conveyed to Chinto Conrotto
and Rose Conrotto, his wife, by deed recorded in
Volume 3512 at page 275, Official Records of Santa
Clara County; thence along the northwesterly line
of said Parcel N.73034'30"E. 225.01 feet to the
most northerly corner thereof; thence along the
northeasterly line thereof S.11021'30"E. 15.06 feet

to the most easterly corner thereof; being also
the most westerly corner of that certain parcel of
land conveyed to Gerhoard Tuting by Deed recorded
August 25, 1922 in Volume 556 of Deeds at page 501,
Records of Santa Clara County; thence along the
northwesterly line thereof N. 73034'30"E. 228.10 feet
to the most northerly corner thereof; thence along
the northeasterly line thereof S.21007'30"E.
281.81 feet to the intersection thereof with the
northwesterly line of Hecker Pass Highway (shown as
Bodfish Mill Road on said Map); thence along the north-
westerly line of Hecker Pass Highway N.70005'E.
322.54 feet to the intersection thereof with the west-
erly line of Morey Avenue; thence along said westerly
line N.4056'50"E. 681.21 feet to the point of beginning,

CONTAINING THEREIN 12.936 acres, and
EXCEPTING THEREFROM the 2.622 acres described in
Section 1 above.
Section 3: The official map constituting a part of the Zoning
Ordinance of the City of Gilroy shall be amended to reflect the
foregoing changes of classification of the said property.
Section 4: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 5: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval.
PASSED AND ADOPTED this 17th day of March, 1969, by the
