Ordinance 856 ..,'" '.:i,., \.~ .;.. -.; ."- -}c: ~r_ . , " ORDINANCE NO. 856 AN ORDINANCE OF THE CITY OF GILROY AMENDING CERTAIN SECTIONS OF CHAPTER 17 OF THE GILROY CITY CODE ENTITLED "PERSONNEL GENERALLYlI. WHEREAS, the City Council has reviewed the Memorandum of Understanding on Wages and Fringe Benefits as approved by the Gilroy Employee's Association, the Gilroy Firemen1s Association, the Police Benefit Association, the duly ap- pointed City representatives, and the Personnel Commission; and WHEREAS, the City Council has publicly heard association representatives explain benefits reviewed by the City Council. NOW, THEREFORE, BE IT ORDAINED that Chapter 17 of the Gilroy City Code be amended to incorporate the Council-approved benefits as follows: Section 17.2. Overtime. It is hereby declared to be the policy of the City that overtime work is to be discouraged. The Department Head shall retain authority of reasonably determin- ing, within the best interests of the operation of their respective departments, the extent of amounts of overtime to be accrued and at what time accrued overtime may be taken off by the employee. Each employee will have the monthly option of accumulating overtime or being paid for the accrued overtime during the following month. Overtime shall be paid or accrued on a straight-time basis. Employees required to attend mandatory courses, training sessions, or drills (except fire drills and burn drills) during off-duty times, shall accrue overtime at the rate of fifty (50) per cent of the training time on a straight-time basis, with a mini- mum one (1) hour guarantee. Fire Department personnel will be compensated for fire drills, burn drills, and overtime, on a straight-time basis. Due to the fact that Fire Department personnel work a 63t hour week rather than a 40 hour week, all accrued overtime shall be multiplied by a factor of 1.6 before the compensating time off is deducted or payment is made in lieu thereof. Police personnel will maintain each month, a continuing balance of twenty-four (24) hours of accrued overtime. Police personnel called back on their days off for court appearances shall be granted a minimum of two (2) hours overtime. Any accrued overtime balance remaining at the end of the fiscal year (June 30) shall be paid as prescribed in this section unless the employee desires to retain a maximum of 24 hours or written permission is granted by the appointing authority to retain any portion in excess of 24 hours. Provisions of this section shall not apply to Department Heads. --.. i) il~/~ .. . j- Section 17.3. legal Holidays. (a) The legal holidays ovserved by the City shall include New Year's Day, lincoln's Birthday, Washington's Birthday, Memorial Day, Independence Day, labor Day, Admission Day, Columbus Day, Veteran's Day, Thanksgiving Day, Christmas Day, Statewide Election Day, and Monday when regular holiday falls on Sunday. The Police Department personnel, excluding the Police Chief, Clerk Matron, Clerk- Typist, and Cadets, will be paid for holidays in lieu of the day off at the rate of 4.24% of the basic salary per month. Fire Department personnel, excluding the Fire Chief, will have the option of taking time off for each holiday at the rate of 16 duty hours per holiday, or payment at the rate of 5.35% of the basic salary per month. (b) Good Friday (12:00 to 3:00 p.m.) allowed to on-duty personnel to attend church. Section 17.6. Sick leave - Maximum Number of Days Allowed. Sick leave may be accumulated with no maximum limit. Section 17. IS. Continuous Employment for One Year. Every full-time employee who shall have been in the service of the City continuously for one year shall annually be allowed vacation leave of ten (10) eight (8) hour working days per year, accumulated at the rate of 0.83 days per month, wi th pay. Section 17.16. Continuous Employment for Five Years. Every full-time employee who shall have been in the service of the City continuously for five (5) years shall commence accumulating vacation leave at the rate of 1.25 days per month, and be allowed an annual vacation leave of fifteen (15) eight (8) hour working days, wlthpav. All present employees who have completed their 6th anniversary year with the City, shall be eligible to receive the annual fifteen working days vacation leave in their present anniversary year. BE IT FURTHER ORDAINED that this ordinance be declared an emergency ordi- nance for immediate adoption and that the benefits for the city employees be made retroactive to July 1, 1969 for compliance with the desire of employee organiza- tions and the Council motion of June 16, 1969. -2- '."
