Ordinance 865 ORDINANCE NO. 865 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 6.1 AND 6.2 OF THE GILROY CITY CODE BY ADOPTING THE UNIFORM BUILDING CODE, 1967 EDITION, VOLUME 1, AND THE APPENDIX THERETO, WITH CERTAIN EXCEPTIONS AND MODIFICATIONS, AND THE UNIFORM MECHANICAL CODE, 1967 EDITION. THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION I. Sections 6.1 and 6.2 of the Gilroy City Code are hereby amended to read as follows: ARTICLE I. UNIFORM CONSTRUCTION CODES mo i ~cation. Sec. 6. 1. For the purpose of setting forth proper regulations for the protection of public health and safety, regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings and structures in the city; providing for the issuance of permits and collection of fees therefor; declaring and establishing fire districts and providing penalties for the violation thereof, the following uniform codes are adopted to apply in the City of Gilroy: A. The Uniform Building Code, 1967 Edition, Volume 1, and appendix thereto, with the following modifications: 1. The second paragraph of section 205 shall not apply, 2. Chapter 70 shall not apply, 3. Group J occupancies in Chapter 15 shall also include fallout shelters for the use of families, which shall comply with the following special provisions: a. Family fallout shelters shall be used for emergency use only. b. The structure shall be of materials approved by the city building inspector. c. Sanitary facilities connected to sewers shall not be permitted. d. Minimum height of rooms shall be six feet six inches. e. Ventilation to be recommended by the civil defense authority. 8 to S-' Section 2517(c) shall be modified to require that all girders within six inches of concrete walks, all girder posts and all muds ills shall be sprayed for termite proofing, and metal flashing shall be installed at all porch and step areas as per detail. Section 3103 shall be modified to require that an access hole eighteen inches (18") by twenty-four inches (24") shall be insta11e d in the exterior wall of the foundation wall within ten feet (10') of the under floor plumbing. The footing of the foundation at this area shall have double reinforcing steel. Section 3203 shall be modified to require that plywood sheathing on roofs shall be a minimum of one-half inch (1/2") in thickness; that roofing nails shall penetrate three-fourth inch (3/4") into sheathing; that a minimum of 6-D galvanized nails shall be used for wood shakes and installed along midline of shake, with minimum of 7-D galvanized nails to be used on ridge shake. B. The Uniform Mechanical Code, 1967 Edition. f. No light source depleting the oxygen content of air in the shelter may be used. g. Entrance arid exit facilities shall be at least twenty-four inches wide; hatchways shall be at least twenty-four inches wide in the minimum dimension. h. Corridor and stairs shall have a minimum width of twenty-four inches and a minimum height of six feet six inches. i. The materials of construction to provide fallout radiation protection shall consist of the equivalent of three feet of earth or three hundred pounds per square foot of mass. 4. Section 25l7(a) shall be modified to require at least eighteen (18) inches minimum clearance under girders and twenty-four (24) inches minimum clearance under sub floors. 5. 6. 7. Sec. 6.2 Review of Plans - additional requirements. It is hereby declared that the erection or location of shacks or other unsightly buildings in the city for dwelling purposes hinders the orderly and harmonious development of the city; may increase the fire hazard and tend to spread disease; impair the desirability of residences, occupation or investment in the city; limit the opportunity to attain the optimum use of land and improvements; lessen the enjoyment of property, and is detrimental to the health, safety and general welfare; and that it is desirable and in the public interest to make reasonable provisions to avoid such results. -2- In case an application is made for a permit to erect, construct or establish a dwelling in the city, except adjacent to any state highway, the application shall be accompanied by drawings and sketches showing the front, side and rear elevations of the building, structure or other building as the same will appear after the work for which the permit is sought has been completed. In addition to specifications, such work and specifications, shall be' referred to the building inspector in an endeavor to provide that such buildings, structures and other improvements shall be so designed and contructed that they will not be of unsightly, undesirable or obnoxious appearance, or detrimental to the public welfare. To this end the building inspector shall suggest any changes in the plans of such proposed buildings, structure or other building as he may deem to be necessary to accomplish the purposes of this section, and shall not approve any such plans or issue any permit until he is satisfied that such purposes will be served thereby. In case the applicant or any property owner adversely effected is not satisfied with the action of the building inspector, he may within thirty days after such action appeal in writing to the city council. The city council shall hold a hearing on such appeal and shall render its decision thereon within thirty days after the filing thereof. No permit, as provided in this section, shall be issued unless the plans and specifications filed with the application therefor, as required in this section, shall first have been approved by the city council. Upon such approval such permit shall be issued. SECTION II. Ordinance 390 of the City, regulating the contruction, erection, enlargement, raising, alteration, repair, removal, maintenance, use and manner of construction of buildings used for theatrical, moving picture or operatic purposes shall not be repealed by this ordinance. All other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION III. This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
