ORDINANCE NO. 866
ORDINANCE OF THE CITY OF GILROY DEFINING AND REGULATING
NUDITY OF WAITERS, WAITRESSES AND ENTERTAINERS IN
ESTABLISHMENTS SERVING FOOD OR BEVERAGE.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
Section 1: Any person, with or without compensation,
who acts as a waiter, waitress, or entertainer, in any
establishment which serves food, beverages, or food and
beverages, including but not limited to alcoholic beverages,
for consumption on the premises of such establishment and
performs such activity in the nude, is guilty of a misdemeanor.
"Nude" as used in this ordinance means the uncovered or
less than opaquely covered:
(a) Male or female genitals;
(b) Pubic areas;
(c) Buttocks;
(d) Female breast below a point immediately
above the top of the nipple;
(e) Female breast with only the nipple and
areola covered.
Any person convicted of a violation of this ordinance
shall be punished by a fine not exceeding five hundred dollars
($500.00), or by imprisonment in the County Jail for not more
than six (6) months, or by both fine and imprisonment, or
either, at the discretion of the Court.
Section 2: All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 3: This ordinance shall take effect and be in

full force thirty (30) days from and after its passage and
approval.
PASSED AND ADOPTED this 15th day of September, 1969, by
the following vote:
