ORDINANCE NO. 870
AN ORDINANCE OF THE CITY OF GILROY AMENDING
SECTION 24.48 OF THE GILROY CITY CODE SO AS TO
REDUCE THE FAITHFUL PERFORMANCE BOND REQUIRED
OF A CATV GRANTEE, AT THE COUNCIL'S DISCRETION,
TO A MINIMUM OF TEN THOUSAND DOLLARS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Section 24.48 of the Gilroy City Code is
amended by adding thereto paragraph (d) to read as follows:
Sec. 24.48 Bond Required.
(d) Subsequent to complete installation of the CATV
system by the grantee and faithful performance of all
obligations under the terms of the franchise for a period
of at least one year, the grantee may apply to the
Council for reduction of the bond required by subdivisions
(a) and (b) to a penal sum in a minimum amount of Ten
Thousand ($10,000.00) Dollars. The Council shall, after
considering the application and the grantee's performance,
fix by resolution the reduced bond amount required. The
Council may at any time for good cause on its own motion
after notice to the grantee and a further hearing,
increase the reduced bond to the original amount required
in subdivision (a), or any part thereof.
SECTION II. All other ordinances and parts of ordinances
in conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and
approval.
