ORDINANCE NO. 876
AN ORDINANCE AMENDING SECTION 12.23 OF THE CITY
CODE OF THE CITY OF GILROY SO AS TO PROVIDE THAT
CHARGES FOR COLLECTION OF GARBAGE, RUBBISH AND
REFUSE SHALL BE FIXED BY RESOLUTION.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Sec. 12.23 of the Gilroy City Code is amended
to read as follows:
Sec. 12.23 Charges for Collection
Maximum charges for the collection of garbage, refuse
and rubbish shall be as fixed from time to time by
resolution of the Council, a copy of which shall be
kept on file at the office of the City Clerk.
SECTION II. All ordinances and parts of ordinances in con-
flict herewith are hereby repealed.
SECTION III. This is an Emergency Ordinance which shall
take effect immediately upon its passage and approval. The facts
and circumstances giving rise to the emergency are as follows:
Amended garbage and refuse collection rates should
take effect immediately so as to be in effect for the
entire year of 1970 so as to permit the City and the
Contractor to enter into a contract for collection
of garbage and refuse at the amended rates effective
immediately.
This Ordinance was introduced as an emergency measure and
passed and adopted to become effective immediately and ordered
published by title and summary in accordance with provisions of
the City Charter at a regular session of the City Council held
on the 5th day of January, 1970, by the following vote:
