Ordinance 892 ORDINANCE NO. 892 AN ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REZONING FROM R3 (LOW DENSITY MULTIPLE RESIDENCE) DISTRICT TO Rl (SINGLE FAMILY RESIDENCE) DISTRICT ALL THOSE CERTAIN PROPERTIES BOUNDED ON THE EAST BY THE CITY LIMITS,ON THE SOUTH BY SEVENTH AND EAST STREETS, ON THE WEST BY FOREST STREET AND ON THE NORTH BY WALNUT LANE SUBDIVISION AND THE GILROY APARTMENT DEVELOPMENT, EXCEPTING THOSE PROPERTIES PROTESTING SAID REZONING BEFORE THE CITY COUNCIL AND THOSE PROPERTIES PRESENTLY HAVING AN R2, R3, R3X or R4 USAGE. WHEREAS, the Planning Commission of the City of Gilroy, has on its own motion initiated the rezoning from R3 District and placing in Rl District the premises hereinafter described; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, and has made its report to the Council of the City of Gilroy, in which it recommends that the hereinafter described premises be rezoned in part from R3 (Low Density Multiple Residence) District to Rl (Single Family Residence) District; and WHEREAS, the Council of the City of Gilroy has fixed the 20th day of July, 1970, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall at No. 7390 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice, before the Council, and the Council having duly considered the said application and the evidence presented, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission, NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: /,","1 -- L ( .- (, I / Section l(a): The Zoning Ordinance of the City of Gilroy is not amended as to the following properties shown as parcels: 841-03-56 64, 66, 67, 69, 70 , 841-05-08 10, 11, 12, 13, 18 , 841-07-02 03, 08, 17, 22 , 841-09-05 12, 13, 14, 15, 16, 17, 18, 19, 27, 28, 36, 38, , 53, 61, 62, 63 841-10-04, 06, 09 Tax Assessor's Map Book. in the Santa Clara County Section l(b): The Zoning Ordinance of the City of Gilroy is hereby amended by removing from R3 (Low Density Multiple Residence) District and placing in R2 (Two Family Residence) District the following properties shown as parcels: 841-03-54, 57 841-05-09, 16, 17 841-06-41, 47, 53, 57 841-07-04, 11, 19 841-09-06, 31, 35, 42, 51, 52 841-10-05, 07 in the Santa Clara County Tax Assessor's Map Book. Section l(c): The Zoning Ordinance of the City of Gilroy is hereby amended by removing from R3 (Low Density Multiple Residence) District and placing in Rl (Single Family Residence) District the following properties shown as parcels: 841-03-55 58, 59, 62, 63, 71 , 841-05-01 02, 03, 04, 05, 06, 07, 14, 15 , 841-06-42 43, 44, 46, 48, 49, 50, 51, 52, 54, 55, 58 , 841-07-05 06, 07, 09, 12, 13, 14, 15, 16, 18, 20, 21, 25, 26, , 27, 28 841-09-01 02, 03, 04, 07, 08, 09, 10, 11, 20, 21, 22, 23, 24, 25, , 26, 29, 30, 32, 33, 34, 37, 39, 40, 46, 47, 48, 49, 50, 54, 55, 57, 59, 60, 64 841-10-08 All of the above properties are described and defined in the Zoning Ordinance of the City of Gilroy within the following described premises: All that certain real property situate in the City of Gilroy, County of Santa Clara, State of California, described as follows: Parcels bounded on the East by the existing city limits, on the South by Seventh and East Streets, on the West by Forest Street and on the North by Walnut Lane Subdivision and Gilroy Apartments Development. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the -2- . foregoing change of classification of the said property. Section 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
