ORDINANCE NO. 900
AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTION
l3.l(b) OF THE CITY CODE PERTAINING TO BUSINESS
LICENSES SO AS TO PROVIDE FOR, DEFINE AND REGULATE
GARAGE SALES.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I. Sec. l3.l(b) of the Gilroy City Code is amended
by adding thereto the following paragraph:
Notwithstanding the provisions of this section and the zoning
laws of the city, a person may obtain a license to conduct
a "garage sale" at his place of residence for a period not
to exceed seven days once each year. Such license shall
state the name of the licensee, the location or address
where the sale is to be conducted, and the permitted dates
of sale, and shall be issued without charge. A "garage
sale" is defined as a sale conducted entirely within a
residence or garage between the hours of 8 a.m. and 8 p.m.
by the resident thereof of personal property owned by him
for at least one year prior to the date of sale and not
acquired for the purpose of resale.
SECTION II. All other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in
full force (30) days from and after its adoption and approval.
PASSED AND 'ADOPTED this 2nd day of November, 1970, by the
following vote:
