Ordinance 918 ORDINANCE NO. 918 ORDINANCE OF THE CITY OF GILROY ADOPTING SECTION 34 OF THE ZONING ORDINANCE SO AS TO ESTABLISH HC (HIGHWAY COMMERCIAL) DISTRICTS. WHEREAS, the Planning Commission of the City of Gilroy has on its own motion studied the advisability of adopting Section 34 of the Zoning Ordinance of the City of Gilroy so as to establish an HC (Highway Commercial) zoning district; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the proposed amendment in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, and has made its report to the Council of the City of Gilroy, in which it recommends that Section 34 of the Zoning Ordinance be adopted so as to establish an HC (Highway Commercial) zoning district; and WHEREAS, the Council of the City of Gilroy has fixed the 5th day of April, 1971, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the proposed amendment, and due notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice, before the Council, and the Council having duly considered the proposed amendment and the evidence presented, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission. NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by adopting the following Section 34: ~ C' L-j / (j SEC. 34 HIGHWAY COMMERCIAL DISTRICT - HC DISTRICT The following regulations, except to the extent that they may be modified by a combining district, shall apply to every building and building site in anHC District and shall be subject to all of the general provisions of this chapter. It is the intent of this district to provide sites for commercial uses that provide services or supply commodities for highway users and which by their nature benefit by a location proximate to a highway access or freeway interchange. 34.1 Permitted Uses in HC District. The following uses may be permitted if their location, plans and landscaping are first approved by the Planning Commission. (ba) Antique stores and gift shops. () Automobile rental agencies. (c) Automobile supply stores. (d) Automobile sales and service agencies. (e) Bank. (f) Banquet Rooms. (g) Bus Depot. (h) Cafes and nightclubs. (i) Grocery, fruit, vegetables or delicatessen stores. (j) Hotels and motels. (k) Restaurants. (1) Other uses similar to the above as may be determined by the Planning Commission. 34.2 Conditional Uses - HC District. The following uses may also be permitted if their location, plans and land- scaping are first approved by the Planning Commission as provided in Section 71: (a) Ambulance service. (b) Bowling alleys. (c) Draying, freighting or trucking yard or terminal. (d) Farm equipment sales and service. (e) Gasoline service station. (f) Meeting halls and convention facilities. (g) Offices and office buildings. (h) Private clubs and lodges. (i) Public buildings and grounds. (j) Public utility and public service structures or installations when found by the Planning Commission to be necessary for the public health, safety or welfare. (k) Skating rinks within buildings. (1) Sports arenas within buildings. (m) Theatres and auditoriums within buildings. (n) Travel trailer and camper overnight facilities. 34.3 -2- 34.5 Front Yard HC District. Front setback shall be 20 fee t. 34.6 Side and Rear Yards. The following side and rear yards shall be required: Districts; 50 feet, 10 feet of which shall be landscaped and fenced to a height of not less than 5 feet, if adjoining an R District; 25 feet, 5 feet of which shall be landscaped and fenced to a height of not less than 5 feet, if adjoining a PO District; and 10 feet fully landscaped if side yard is across street from an R, PO or C District. 34.7 Other Required Conditions. (a) All business to be conducted entirely within a completely enclosed structure, except for off-street parking and loading, service stations, outdoor dining areas, farm equipment and auto sales. Uses not conducted entirely inside a structure on a site abutting or across the street from an R or PO District shall be screened by a wall, fence or hedge 5 feet high. (b) No use shall be permitted which is objectionable because of odor, fumes, dust, smoke, cinders, dirt, refuse, water carried wastes, noise, vibration, illumination, glare, unsightliness, fire hazards or potential explosion. (c) All uses shall meet parking and sign requirements of this ordinance. (d) All products produced on the site of any permitted use shall be sold primarily at retail on the site where produce d. Section 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 3: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
