ORDINANCE NO. 929
AN ORDINANCE OF THE CITY OF GILROY AMENDING THE
TITLE OF CHAPTER 21A OF THE CITY CODE PERTAINING
TO SWIMMING POOLS AND ADOPTING REGULATIONS AS TO
PROTECTIVE DEVICES AND THE LOCATION OF SWIMMING
POOLS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I. The title of Chapter 21A of the Gilroy City Code
is amended to read as follows:
CHAPTER 21A
SWIMMING POOLS
SECTION II. The following sections are hereby adopted as
part of Chapter 21A of the Gilroy City Code:
Sec. 21A.2
Swimmin~ Pool Discharge and Connection to
Public anitary Sewer.
All swimming pools shall discharge to the public
sanitary sewer. Discharge to the street surface or to a
storm drain is prohibited. The property owner shall provide
a 2" minimum size trap on the connecting lateral to the
sanitary main.
Sec. 21A.3. Swimming Pools - Protective Devices Required.
(a) Fences Required. Every person owning land on which
there is situated a swimming pool 18 inches or more in depth at
any point, shall erect and maintain thereon an adequate fence
sufficient to make such artificial body of water inaccessible
to small children. Such fence or wall, including gates
therein, must be not less than four feet in height above the
underlying ground and be constructed of such materials and
in such manner that the exterior surface is unbroken and
difficult to scale or climb over. All gates must be self
latching with adequate latches placed four feet above the
underlying ground or otherwise made inaccessible from the
outside to small chi1dren~

1. As to single family dwellings, fencing around
the perimeter of the yard in whkh the pool is located may
be deemed to comply with this section if the fence, gates and
latches meet the minimum requirements set forth above.
2. As to multiple dwelling units, fencing gates
and latches which meet the minimum requirements set forth
above shall be provided around all pools.
(b) Time for Compliance. All persons maintaining such
bodies of water shall comply with the provisions of this
section within 10 days after the receipt of a notice to
comply with this section from the City of Gilroy.
(c) Modifications. The City Engineer may permit other
protective devices to be used so long as, in his judgment,
the degree of protection afforded by the substitute devices
or structures is equivalent to the protection afforded by the
fence, gate and latch described herein.
Sec. 21A.4. Swimming Pools - Location. Private or
public swimming pools hereafter constructed shall be located
to comply with the following requirements:
(a) Prohibited - Front Yard. No swimming pools shall be
constructed in a required front yard.
(b) Distance from Property Lines, Fences and Walls.
The distance from the inner surface of the pool wall to
any property line, fence or wall shall be not less than five
feet.
(c) Distance from Buildings. The distance from the
inner surface of the pool wall to the bearing wall of a
dwelling, main building, garage or other accessory building
shall be not less than five feet.
Sec. 21A.5. Variances - Swimming Pool Location. The
City Council may, upon application of any property owner or

lessee of the property affected, grant, upon such terms and
conditions as it deems necessary, such variances from
Section 21A.4. as may be in harmony with its general purpose
and intent. The fee, if any, for filing such application
shall be established by council resolution.
SECTION III. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION IV. This ordinance shall take effect and be in force
thirty (30) days from and after its passage and approval.
PASSED AND ADOPTED this 19th day of July, 1971, by the
