Ordinance 942 ORDINANCE NO. 942 AN ORDINANCE OF THE CITY OF GILROY TO PROVIDE THAT ARTICLE VI OF CHAPTER I OF TITLE FIVE OF THE SANTA CLARA COUNTY ORDINANCE CODE, AS THE SAME NOW EXISTS OR MAY HEREAFTER BE AMENDED, RElATING TO RAW MILK SALES SHALL APPLY IN THE CITY OF GILROY THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION I: The following is hereby adopted as Chapter 18B of the Gilroy City Code: CHAPTER 18B RAW MILK SALES Sec. 18B.1. Raw Milk Sales. Article VI of Chapter I of Title Five of the Santa Clara County Ordinance Code, as the same now exists or may hereafter be amended, relating to raw milk sales shall appp1y in the City of Gilroy. SECTION II: All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION III: This ordinance shall take effect and be in force thirty (30) days from and after its passage and approval. (,,' " - <,-.LceK<2 / /1. -~-il.1- C~tpClerk ORDINANCE NO. 942 ',,, 5.1.6-1.10: GUARANTEED RAW MILK "Gunranteed raw milk" is market milk which conforms to the following mlnJIl1\IlTl rC(lulr(~ment3: (1) The health of the cows and goats shall be determined at least once each month by an official representative of a milk inspec- tion service approved or established by the director of State Department of Agriculture; (2) It shall be produced on dairy farms which score not less than ninety (90%) percent on the dairy farm score card; (3) It shall be bottled on the premises where produced and delivered in containers having the pouring lip completely protected from contamination; (4) It shall be cooled immediately after being drawn from the cow or goat to 50 degrees Fahrenheit or less, and so maintained unti.l delivered to the consumer, at which time it shall contain not more than 10,000 bacteria per milliliter; (5) It must be sold to the consumer within thirty (30) hours after production ~nd labeled to indicate the date of sale to the consumer. All persons who come in contact with the guaranteed raw milk must exercise scrupulous cleanliness and not afflicted with any conmruni.cable disease or in a condition to disseminate the germs of nny communicnble disease liable to be conveyed by mi 1 k. The ahsc'1ce of such germs in all such persons sha 11 be determined by bacteriological and physical examination by the Health Department or other person or laboratory approved in writing by the Health Department, conducted at the time of employment and every six months thereafter in a manner approved by the Health Officer. Such commission shall make fair and uniform rules pertaining to certified milk, and shall certify milk for any applicant who com- plies with such rules and the standards prescribed in this ordi- nance. All cream. skimmed milk, buttermilk, or other dairy products sold, designated or advertised as certified shall be conspicuously marked with the name of the commission certifying it and certifying t~e milk from which such cream, skimmed milk, and other dairy product is obtained. (Ord NS 505.2; 9-21-60) 5.1.6-13: RAW MIU< S!\LES No person shall sellar distribute to the retail trade in Santa Clara County any raw milk, cream or other dairy product that does not meet the standards of certified raw milk or guaranteed raw milk as defined in this ordinance.
