ORDINANCE NO. 943
AN ORDINANCE OF THE CITY OF GILROY AMENDING
SECTION 24.90 OF THE GILROY CITY CODE RELATING
TO CATV LINE EXTENSION CHARGES.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I: Section 24.90 of the Gilroy City Code is amended
to read as follows:
Sec. 24.90. Line extension charges.
Line extension charges shall not be allowed in any areas
where the number of occupied houses is greater than fifty
per mile of line.
Line extension charges shall not be allowed if the
nearest point on the highway right of way from which the
service applicant could reasonably be served is within
a distance of 150 feet from any existing CATV service
line connection.
For unusual circumstances such as to install underground
cable, to install more than 150 feet of cable to the
nearest service connection, for extensions on present
outlets, to transfer outlets or cable to a different
location on the same premises, to install deluxe type
outlet receptacles, or to prewire multiple outlets on
residential and commercial units, an additional
installation charge over that normally charged may be
made on the basis of actual cost of labor and materials
on terms agreed to in advance in writing by the applicant
or applicants. All easements shall be furnished or paid
for by the applicant or applicants.
SECTION II. All other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and
