ORDINANCE NO. 954
AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING
ALL THAT PORTION OF THE MOST NORTHERLY TEN (10) FEET OF
CASEY STREET IN THE CITY OF GILROY LYING BETWEEN SWANSTON
LANE AND TO ONE HUNDRED (100) FEET EASTERLY OF SOUTHERN
PACIFIC RAILROAD RIGHT OF WAY.
WHEREAS, the Council of the City of Gilroy has heretofore and on the

6th day of March, 1972, passed and adopted Resolution No. 1634 declaring its
intention to proceed under the Street Vacation Act of 1941 to vacate a portion
of a certain street in the City of Gilroy hereinafter described; and
WHEREAS, the City Council of the City of Gilroy, in accordance with
said Street Vacation Act of 1941, has caused notices of the adoption of said
resolution to be published in the Gilroy Dispatch, a newspaper of general cir-
culation, publ ished in the said City of Gilroy, in the manner and form required
by law, and the said street or thoroughfare has been posted in the manner and
form required by law; and
WHEREAS, no objection to the said proposed vacation of said street
has been filed at or before the hearing held by said council on the 3rd day of
April, 1972, at the hour of 8:00 o'clock p.m., at the Council Chambers in the
City Hall, at No.7390 Rosanna Street, in the said City of Gilroy, the time and
place fixed for the hearing in said notices, and the said hearing has been held
at the said time and place, and the council has duly considered the matter of
vacating the said street, as the same is hereinafter described and has deter-
mined that said premises are no longer needed or required for public purposes
by the said City of Gilroy.
NOW THEREFORE, the Council of the City of Gilroy does ordain as
follows:
Section I. The following described portion of Casey Street, being
the premises hereinbefore mentioned, within the said City of Gilroy, is hereby
vacated and abandoned:

All of the most northerly ten (10) feet of Casey Street in the
City of Gilroy lying between Swanston Lane and to one hundred
(100) feet easterly of Southern Pacific Railroad Right of Way.
Section 2. The Council does declare that the public convenience and
necessity requires the reservation of easement and right-of-way for structures
enumerated in Section 8330 of the Streets and Highways Code of the State of
California, and the vacation and abandonment of the portion of Casey Street
hereinabove described shall be and is subject to the reservation and exception
of the permanent easement and right for any existing public utility service above,
across or under the above described ten (10) feet strip of land.
Section 3. This ordinance shall take effect and be in full force
thirty (30) days from and after its passage and approval.
Section 4. The foregoing ordinance was introduced at a regular meeting
of the Council and ordered published by title and summary at a regular meeting
of the City Council held on the 3rd day of April, 1972, and was finally adopted
and passed at a regular meeting of the Council held on the 17th day of April,
1972, by the following vote:
