Ordinance 1002 ORDINANCE NO. 1002 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 10.9 and 10.10 OF THE GILROY CITY CODE SO AS TO ADOPT THE 1973 UNIFORM FIRE CODE AS MODIFIED AND AMENDED BY PORTIONS OF SANTA CLARA COUNTY ORDINANCE NO. NS-800.7 AND BY PERMITTING "SAFE & SANEIt FIREWORKS. THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: to read: Section 1: Section 10.9 of the Gilroy City Code is amended Sec. 10.9 Adoption. There is hereby adopted by the council of the city for the purpose of prescribing regulations and governing conditions hazardous to life and property from fire or explosion, that certain code known as the 1973 Edition of the Uniform Fire Code, including Appendicies A, B, C, D and E only; as compiled and published by the International Conference of Building Officials and the Western Fire Chiefs Association. Said Uniform Fire Code, three copies of which have been filed in the office of the City Clerk, is hereby referred to, and except as to omissions, amendments and additions set forth in section 10.10, is hereby adopted and made a part hereof, the same as if fully set forth in this article and the provisions thereof shall be controlling within the limits of the city. Section 2: Section 10.10 of said Code is amended to read: Sec. 10.10 Amendments. (a) The Uniform Fire Code adopted by section 10.9 is amended by adopting to apply in the city the following sections of Division B7 of the Santa Clara County Ordinance Code as enacted by Santa Clara County Ordinance No. NS-800.7, three copies of which have been filed in the office of the City Clerk, except that all references therein to the County Fire Marshall shall be read to mean the Fire Chief of the City of Gilroy: f~~ (3) (4) (5) (6) (7) (8) (9) (10) (b) read: Sections B7-9 to B7-l3 inclusive. Sections B7-l5 to B7-32 inclusive. Sections B7-34 to B7-40 inclusive. Sections B7-42 and B7-43. Sections B7-46 and B7-47. Section B7-49. Section B7-53. Section B7-55. Section B7-57. Section B7-60. Section l2.l02(d) is added to the Uniform Fire Code to Sec. l2.l02(d) The Chief shall also have the power to adopt reasonable rules and regulations for the granting of permits for the retail sale of "Safe and Sane" fireworks, as defined by the California State Fire Marshall, and such fireworks may be sold and dis- charged from June 28 to July 6 of each year. ORDINANCE NO. 1002 -1- Section 3: All other ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its adoption.
