ORDINANCE NO. 988
AN ORDINANCE OF THE CITY OF GILROY AMENDING
CHAPTER 6, ARTICLE II OF THE GILROY CITY CODE
REIATING TO FENCES
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I; Section 6.6 of the Gilroy City Code is
amended to read as follows:
Sec. 6.6 Location and height.
No fence shall be constructed, erected or placed upon
any property having a residential usage within the city except
as follows:
a) Along any alley the height of a fence shall not
exceed seven feet from the ground.
b) From the rear property line to the front setback
line, as established by the zoning ordinance, the
height of the fence shall not exceed six feet.
c) Along the street side yard of a corner lot and if
not within the side setback as established by the
zoning ordinance, the height of a fence shall not
exceed six feet.
d) In all other cases, a fence shall not exceed
three feet in height.
e) In all cases, a fence shall not be placed or
constructed closer than twelve inches from the
existing or future street right of way line.
Any person who wishes to construct a fence contrary to
the provisions of this article must first obtain per-
mission from the Architectural and Site Approval
Committee as provided in the zoning ordinance.
SECTION II: Section 6.7 of the Gilroy City Code is
amended to read as follows:
Sec. 6.7 Permit, application, diagram, etc.
No fence shall be erected in the city without a permit
first obtained from the building inspector of the city, and the
application for the permit shall show the location of the fence
on a sketch, diagram, or plat of the property on which it is to
be erected or placed, and the location and designation of the
buildings thereon. Also the type of construction, the materials
to be used and the height of the proposed fences shall be
approved by the building inspector of the City. The proposed
fence shall not detract from the neighborhood and shall be an
acceptable improvement.

SECTION III: Section 6.8 of the Gilroy City Code is
amended to read as follows:
Sec. 6.8 Removal and penalty for violation.
a) Any person who owns or erects a fence contrary to
the provisions of this article shall remove it
upon the order of the building inspector.
b) Any person violating any of the provisions of
this article shall be deemed guilty of a
misdemeanor.
SECTION IV: All other ordinances and parts or ordi-
nances in conflict herewith are hereby repealed.
SECTION V: This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and
approval.
