AN OtlDINANCE OF THE CITY OF GILROY ENACTING SECTION
13.40-31a OF THE GII,ROY CITY CODE SO AS TO PROVIDE
LICENSE FEES FOR ITINERANT I~_[ERCHANTS
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I. Section 13.40-31a of the Gilroy City Code is enacted
to read as follows:
Sec. 13.40-31a - Itinerant Merchants.
An itinerant merchant under this Part shall be deemed and
construed to mean and include any person or persons, firm,
or corporation, either principal or agent, employer or
employee who engages in a temporary business in the City by
selling or offering for sale, goods, wares, merchandise,
or things or articles of value, for a period of not more
than one hundred ninety (190) days, and who, for the purpose
of carrying on such business, hires, leases, or occupies
any room, building, structure or stand on any real property,
or on or adjoining any street or public .place in the City,
The person, firm or corporation so engaged shall not be
relieved from the provisions of this section by reason of
associating t~nporarily with any local dealer, trader,
merchant or auctioneer, or by reason of conducting such
temporary business in connection with or as a part of any
local business, or in the name of any local dealer, trader,
merchant or auctioneer.
Every person, firm, or corporation engaged in the business
of an itinerant merchant shall pay a license fee of $150.00
per year, $50.00 per"quarter or $10.00 per day.
SECTION II. All other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in full
force thirty (30) days from and After its adoption and approval.
