Ordinance 1977-21ORDINANCE NO, 77-21 ORDINANCE OF TI~ CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REZONING THE SOUTHWESTERLY 5.0 ACRES OF THAT 18.34 ACRE PARCEL LOCATED SOUTHWEST OF MESA ROAD AT THE TERMINUS OF MILLER AVENUE FROM IZ DISTRICT TO Ri DISTRICT. WHEREAS, application has heretofore been made by DONALD CHRISTOPHER to the Planning Commission of the City of Gilroy for the rezoning of the premises hereinafter described from IZ to Ri District; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zohing Ordinance of the City of Gilroy, has held the hearing, has approved a Negative Declaration and has made its report to the Council of the City of Gilroy~ in which it recommends that only the southwesterly 5.0 acres of the hereinafter described premises be rezoned from IZ (Interim Zone) District to RI (Single Family Residence) District; and WHEREAS, the Council of the City of Gilroy has fixed the 20th day of June, 1977, at the hour of 8:00 o~clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance wi~h the said zOning Ordinance, and a public heari[~g has now been held upon the said application, at the time and place fixed in the said notice, before the Council, and the Council having duly considered the said application and the evidence presented, has approved the Negative Declaration and has determined that the said Zoning Ordinance should be amended in accordance with the report ~f the said Planning Commission, NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN -1- ORD!NA~CE NO. 77-21 AS FOLLOWS; Section 1; The Zoning Ordinance of the City of Gilroy is hereby amended by removing from IZ District and placing in RI District, as the same is described and defined in the Zoning Ordinance of the City of Gilroy, the following described premises: Ail that certain real property situated in the City of Gilroy, County of Santa Clara, State of California, described as follows: The most southwesterly 5.0 acres of that 18,34 acre parcel southwest of Mesa Road at the terminus of Miller Avenue and identified as County of Santa Clara Assessor's parcel number 810-24-4. Section 2: The o~ficial map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the fore- going changes of classification of the said property. Section 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
