Ad ORDINANCE PROVIDING FOR TIlE ALTERATIONS OF THE
BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION
Tt~RETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED
AS "~'~NTELLI ANNEY~TION 77-4 TO THE CITY OF GILROY"
~tEREAS, a ~itten petition has been filed in the office of the
City Clerk of ~he City of Gilroy in accordance with the provisions
of the Annexation of Uninhabited Territory Act of 1939, asking that
there be annexed to the City of Gilroy certain uninhabited territory
located in the County of Santa Clara, State of California, herein-
after more particularly described; and
~{EREAS, said petition has been signed and consented to by the
owners of all of the land in the territory proposed to be annexed
and said territory is contiguous to the City of Gilroy; and
~[E?~AS, an application for annexation of the said premises has
been filed with the Santa Clara County Local Agency Formation
Commission, and said Co~mnission did make its determination upon tbe
proposed annexation, and has approved and authorized said annexation
as proposed pursuant to section 54797.1 of the Government Code; and
~iEREAS, pursuant to Section 35015 of the Government Code the
territory is to be annexed without notice and hearing, and without
an election; and
~tEREAS, the m/nets of all of the territory proposed to be
annexed consented in writing to said annexation prior to the adoption
of this Ordinance, pursuant to section 35319 of the Government Code
property within said territory mc~y be taxed by the City of Gilroy
to pay any indebtedness or l!abil-ty of said Ci~v contracted prior
to or existing at the time of annexation.

Section I: Under the authority of the said "Annexation of
Uninhabited Territory Act of 1939", and SeCtion 35015 of the Govern-
ment Code of the State of California, there is hereby annexed to the
City of Gilroy the uninhabited territory particularly described as
follows
BEING a portion of that certain 22.2 acre parcel of land
as described in the Deed from Anna Schmidt to Maitland
Alfred Chappell and Nettie Almira ChappeI1, husband and
wife, which Deed is recorded in Book 3976, page 457 Offi-
cial Records of Santa Clara County, California, and being
more particularly described as follows:
BEGINNING at a 1 inch iron pipe at the southeasterly corner
of the said 22.2 acre parcel of land, said point of begin-
ning being also on the Gilroy City Limit line as establish-
ed by Pappani Annexation 76-3, Ordinance 76-16; thence
along the southerly line of said 22.2 acre parcel and said
City Limits line. South 89° 50' W. 241.37 feet to the
easterly line of Mantelli Annexation No. 1, 70-4, Ordinance
No. 917; thence northerly along said annexation North 0° 10'
22" W. 778.90 feet to the southerly line of Northwest Annex-
ation 65-1 Resolution No. 959; thence easterly along said
annexation N. 84° 14' 01" E. 310.05 feet to a ! inch iron
pipe set at the northeasterly corner of that certain 10.332
acre tract of land described as Parcel One in the deed from
Maitland Alfred Chappell et ux, to Edwin J. Valencia et ux,
recorded in Book 6487 Official Records, page 69, Santa Clar
County Records; thence leaving said city boundary $. 4° 34'
30" W. 811.93 feet to the point of beginning and containing
5.0 acres.
Section II: Said Council does hereby further declare and
order that all property within said designated territory shall be
taxed by the City of Gilroy, upon its annexation to said City, to
pay any indebtedness or liability of the City of Gilroy contracted
prior to or existing at the time of annexation, said property to be
taxed equally with other property in said City taxable for such
purposes.
Section III: The said territory hereby annexed to the City
of Gilroy is hereby designated as "MANTELLI ANNEXATION &7-4 TO THE
CITY OF GILROY".
Section IV: This ordinance shall take effect and be in full
force from and after the date of the filing of a certified copy of
this ordinance in the office of the Secretary of State.
PASSED AND ADOPTED this 15th day of August, 1977, by the fol-
