Ordinance 1979-02ORDINANC~ NO. 79-2 OPdPINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REZONING A 0.629 ACRE PARCEL ON THE NORT}UWEST CORNER OF! TENTH AND CHESTNUT STREETS FROM M2 (GENERAL INDUSTRIAL) DISTRICT TO CM (COMMERCIAL INDUSTRIAL) DISTRICT. ' WHEREAS, application Z 78-26 has heretofore been made by FRANK DELLA }IAGGIORA to the Planning Commission of the City of Gilroy for the rezoning of the premises hereinafter described from M2 to CM District; and Wt~REAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved a Negative Declaration under the California Environmental Quality Act, has determined that the rezoning will not have a signifi- cant adverse effect on the environment, and has made its report to the Council of the City of Gilroy, $n which it recommends that the herein- after described premises be rez0ned from M2 (General Industrial) District to CM (Commercial Industrial) District; and W}~REAS, the Council of the City of Gilroy has fixed the 2nd day of January, 1979, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said ZOning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice before the COuncil, and the Council having duly considered the said application~and the evidence presented, has approved the Negative Declaration under ~he California Environmental Quality Act, a~d has determined that the said Zoning Ordinance should be amended ORDINANCE NO. 79-2 in accordance with the report o NOW, THEREFORE, THE COUNCIl FOLLOWS: , !the said Planning Commission. OF THE CITY OF GILROY DOES ORDAIN AS Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by removing from M2 District and placing in CM District, as the same are described and defined in the Zoning Ordinance of the City of Gilroy, the following described premises: Ail that certain real property situated in the City of Gilroy, County of SantalClara, State of California, described as follows: ~ That 0.629 acre parcel on the northwest corner of Tenth and Chestnut Streets and identified as Santa Clara County Assessor's Parcels No. 841~16-75 and 76. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the fore- going changes of classification of the said property. Section 3: Ail ordinances and parts of ordinances in conflict herewith are hereby repealed.
